    • I'm still pondering/ trying to find docs re the above issue. Moving on - same saga; different issue I'm trying to understand what I can do: The lender/ mortgagee-in-possession has a claim v me for alleged debt. But the debt has only been incurred due to them failing to sell property in >5y. I'm fighting them on this.   I've been trying to get an order for sale for 2y.  I got it legally added into my counterclaim - but that will only be dealt with at trial.  This is really frustrating. The otherside's lawyers made an application to adjourn trial for a few more months - allegedly wanting to try sort some kind of settlement with me and to use the stay to sell.  At the hearing I asked Judge to expedite the order for sale. I pointed out they need a court-imposed deadline or this adjournment is just another time wasting tactic (with interest still accruing) as they have no buyer.  But the judge said he could legally only deal with the order at trial. The otherside don't want to be forced to sell the property.. Disclosure has presented so many emails which prove they want to keep it. I raised some points with the judge including misconduct of the receiver. The judge suggested I may have a separate claim against the receiver?   On this point - earlier paid-for lawyers said my counterclaim should be directed at the lender for interference with the receiver and the lender should be held responsible for the receiver's actions/ inactions.   I don't clearly understand that, but their legal advice was something to do with the role a receiver has acting as an agent for a borrower which makes it hard for a borrower to make a claim against a receiver ???.  However the judge's comment has got me thinking.  He made it clear the current claim is lender v me - it's not receiver v me.  Yet it is the receiver who is appointed to sell the property. (The receiver is mentioned/ involved in my counterclaim only from the lender collusion/ interference perspective).  So would I be able to make a separate application for an order for sale against the receiver?  Disclosure shows receiver has constantly rejected offers. He gave a contract to one buyer 4y ago. But colluded with the lender's lawyer to withdraw the contract after 2w to instead give it to the ceo of the lender (his own ltd co) (using same lawyer).  Emails show it was their joint strategy for lender/ ceo to keep the property.  The receiver didn't put the ceo under any pressure to exchange quickly.  After 1 month they all colluded again to follow a very destructive path - to gut the property.  My account was apparently switched into a "different fund" to "enable them to do works" (probably something to do with the ceo as he switched his ltd co accountant to in-house).   Interestingly the receiver told lender not to incur significant works costs and to hold interest.  The costs were huge (added to my account) and interest was not held.   The receiver rejected a good offer put forward by me 1.5y ago.  And he rejected a high offer 1y ago - to the dismay of the agent.  Would reasons like this be good enough to make a separate application to the court against the receiver for an order for sale ??  Or due to the main proceedings and/or the weird relationship a borrower has with a receiver I cannot ?

    • You could send an SAR to DCbl on the pretext that you are going for a breach of your GDPR . They should then send the purported letter of discontinuance which may show why it ended up in Gloucester and see if you can get your  costs back on the day. It obviously won't be much but  at least perhaps a small recompense for your wasted day. Not exactly wasted since you had a great win  albeit much sweeter if you had beat them in Court. But a win is a win so well done. We will miss you as it has been almost two years since you first started out on this mission. { I would n't be surprised if the wrong Court was down to DCBL}. I see you said "till the next time" but I am guessing you will be avoiding private patrolled car parks for a while.🙂
    • It is extremely disappointing that you haven't told us anything about the result of the hearing. You came here at the very last minute and the regulars - all unpaid volunteers - sweated blood trying to get an acceptable Witness Statement prepared in an extremely short time. The least you could have done is tell us how the hearing went, information invaluable for future users. Evidently not.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I find myself in new territory and would appreciate some guidance if possible.

 

My sister is terminally ill and we are a very small family. This consists of:

 

Daughter (K)

2 Grand children

Older sister in Europe (RB)

Me (sister) been caring for her (RD)

 

My niece (K) has no problem with me dealing with all official and non official things because she is not coping with her mothers prognosis. However, I am obviously aware that my niece is the next of kin and we are communicating everything together at each step of the situation as it arises.

 

Big sis in Europe not coming over until Christmas or the funeral, whichever comes first!

 

Now, as my sister has not made a will this will leave us managing her estate in accordance with government guidelines.

There is no property involved

- under £2k funds

- £500 debt besides the usual utility bills.

In receipt of P.I.P and motability vehicle in operation.

In receipt of Tax Credits (albeit they have been calculated incorrectly and I am currently dealing with, via letter of authorisation)

Funeral paid for in cash 6 months ago

Old PPI plans are being dealt with/ or have been dealt with accordingly.

 

In order to reduce timesframe and undue stress (I lost my husband in April) I would very much appreciate 'official quick fixes' if they exist or alternatively, smooth solutions to keep anxiety to a minimum.

 

P.S: Title appropriate because we have a good sense of humour - NOT intended to offend.

I'd say you have just about everything covered. The biggest stress point would be the funeral and associated expenses, but as this is already paid for, that leaves the emotional side of things to deal with when the time comes.

When the time does come, you should be able to get a grant of administration from the Probate Registry for free as the estate is likely to be well under the £5,000 limit.

 

Fingers crossed that the Christmas reunion passes off without incident.

Thank you both. I have requested the administration pack today to read up when im bored, and yes we do have comical moments but some are not printable.

We've enjoyed a takeaway this evening (with a sneaky sip of wine) because the NHS menu isn't fit for consumption. Bazaar that really! Waited an hour Sunday for a jug of water but that's for another thread!

 

Spoke to the bank and they'll want their form signed by a solicitor?

Waited an hour Sunday for a jug of water

 

The hospital my mother was in last Christmas switched to bottled water after an outbreak of norovirus. You might want to consider taking a few bottles in for her (slip a bottle of wine in too :-)). If you haven't already seen them, the Robinsons Squash'd are very handy in a hospital environment.

any chance of changing the heading to a better description ? as the one above is rather out of line to the situation and not at all funny!? something like Terminally Ill = better respect to the person in question!

 

The chosen heading for this thread represented the humour of my sister and YOU have offended me by requesting it be changed - YOU don't know her and have nothing other than your opinion to the thread title so why have you butted in?

Sorry to hear of your family distress Shelley. It's never easy no matter how many people we support at the end of life events just ignore any comments from those who should know better. We all handle such in our own ways there is no right or wrong way to die or grieve. Citizens Advice have their own solicitors who will be able to assist around administration matters without huge bills to worry about and the Probate a Registry are great. Thinking of all of you, especially you and those who are looking on.

Andy sent me a message regarding 'unhappy' people due to my choice of title but it seems they've won.

Anyway, I have printed off the link you sent me and will read it during the night.

I have spoken with the Probate team and they have been very helpful and will send out liturature as well.

Hassle withthe bank is my main concern but I will post a seperate thread for that, might interest you?

 

In regards to the water bottle suggestion, I do take in own water supply and Lactose milk because the hospital can't accommodate the latter. Bazaar really when they cater for all other ethnic groups but I won't get into that here.

I did sneak a small shot of wine in the other evening when we dined with Sweet/sour chicken takeaway - she thought it was really naughty, but she enjoyed it bless her.

 

The tip for CAB legal advisors is useful - right under my nose but in circumstances like this at these stress levels I never gave them a thought! I will do though next week.

 

My sister managed a smile and some squash today so I'm happy for now :)

 

Off to do the night shift - with homework in bag.

I lost a close relative last year and the last thing he would have wanted is people crying and moaning.

Everyone is different and some people

on their death bed.

Title not offensive at all.

This is our families sense of humour. My late husband even knew he was going in a black bin bag under the patio but he had a very dignified send off in a 'proper' cemetery, flowers and everything. Lol.

A colleague of mine who had two open heart Operations in the past 3 years keeps on making jokes about him passing away during important meetings to cause max disruption.

He laughs about it every day.

Maybe that's what is keeping him alive 😊

No one likes to think of their own mortality - when I booked my late husbands funeral they asked is I wanted a single or double plot? WOW! I hadn't thought about it - I don't intend to join him for quite awhile, although I did have a recent scare so I'm trying to take things easier.

There was nothing wrong with your title? I wondered what was so wrong with it! It is Simple and HONEST. Not dead yet, but close. I thought it must have been something obscene. Maybe folk can not handle that.

It is a pure honour and blessing to be with someone as they die.

My sister passed away 7th December 2015 :(

 

She did find it rather funny that she was the centre of an internet community forum discussion and I can't repeat her response - you would delete my account, lol.

 

My grief has visited me in waves and I continue to laugh in the face of sorrow, as she would us too.

My grief has visited me in waves and I continue to laugh in the face of sorrow, as she would us too.

 

Nine months on, and I still find certain things trigger strong emotions and a feeling of loss. Doing a first aid course last week, and I found the CPR practicals really difficult to cope with...

Hi Shelley,

I am so very sorry for your loss of a wonderful sister.

 

On reading your posts she sure sounds like she had a wicked sense of humour indeed. I loved the sneaking of a drop of wine & having a take away.

 

The time you spent together as she faced her final journey, will be the most cherished of memories.

Having my CAG family at my fingertips is very comforting - without which I have no idea how I would cope.
