    • Amazing thanks, I am not sure what to type as this is the first time I have got to this stage with the FOS, but my letter below is a start and would appreciate any comments/amends to suit:   Complaint about MYJAR Limited - Trading as MYJAR Reference Number XXXXX   Thank you for your email of the 29th June 2020, the contents of which are noted.   I have to say I am somewhat surprised and disappointed by the outcome of this and I would like to explain why.   Firstly, I attach a spreadsheet showing the state of my credit file.  This show the Default date to/from the amount of the Default, including CCJs.  In total I had 10 Defaults and 3 active CCJs at the time of the first loan taken out with MyJar.   Two of the CCJs were paid off in July 2017, however, and still remain on my credit file until September 2020/March 2021 respectively.   This should have been a sufficient warning to MyJar that they should not have lent any monies to me whatsoever.  However, they went ahead and, as you can see continued to lend to me each time, when all of the Defaults and CCJs were still active on my credit file.   Also, with regards to the table below, you can clearly see that another loan was taken out straight after the existing one.  I understand that you cannot have more than one MyJar loan at any one time, but what I would do is use my salary to clear the loan and then borrow again from MyJar to cover the amount that I had paid off….. in a sense “robbing Peter to pay Paul”.   Loan Date Taken Date Repaid Instalments Amount Highest Repayment 1 05/11/2017 22/11/2017 6 £1,000.00 £284.63 2 05/12/2017 06/02/2018 12 £1,475.00 £266.20 3 16/03/2018 18/07/2018 12 £800.00 £117.87 4 23/07/2018 outstanding 12 £725.00 £110.82   I would also like to state that Loan 4 is still outstanding as the account has been placed on hold whilst the investigation took place with yourself.  They have, however, offered me a settlement figure of £600 and to clear this balance at a rate that is acceptable to myself.   Looking back at previous correspondence, I still feel that all interest and charges that I have paid should be refunded.  This totals £725.90 across all loans.  This would therefore settle Loan 4 of £600 and the remaining monies of £125.90 owed to myself.   I would therefore ask that my case is reviewed with the additional information stated above.
    • Hello to all.  Any help or advice is greatly received.                      I traded in my car almost a year ago and purchased a second hand kia optima 2013 with around 75000 on the clock, and 127 a month in HP payments. After 5 and a half months of normal use the engine seized, the reverse camera and sensors no longer worked and the passenger seat belt alarm continuously sounds at various times when no one is seated in it. I had also needed to renew pads and a brake calliper almost 4 months after purchase. I had not raised concerns to the brake components as they would be considered wear and tear.                     Being in the industry I dropped the oil and found it to be extremely thick and probably not circulating to the top of the engine, i.e. the oil had not been renewed in a very long time (there is no oil light on the dash or any indication of fault or maintenance due) I retained the oil filter, and opened a resolver case, with tall the faults listed.                 Upon contacting the dealer and informing him of what happened he indicated he wanted no responsibility towards rectifying the problem as close brothers were technically the owner. I approached close brothers (18th February)who started the ball rolling and approached dealer again who formally by letter refused liability.                              Close brothers then sent an engineer to inspect my listed problems, this was visual as the vehicle will not move, after three weeks the report was with my case handler.  I requested this report twice but have yet to see it.  Close brothers informed me that the report was inconclusive and they would need to move to a more through inspection.             At this stage the pandemic hit, at no point did I stop work and had to continue on charity and the diminished public transport to commute to work (140 miles a week)  no courtesy car or rental was provided.  I maintained contact with close brothers throughout, and was given the same update, they were waiting for the engineering firm to do an assessment but they were only doing key workers . Despite me telling them I was a key worker, nothing was done until the easing of the lockdown. I was informed that ACE vehicle inspection would contact me to collect the oil filter.                             Eventually this happened on the 18th of June and I phoned each week to chase. I was informed on the 30th that the report was showing on the portal and my case handler (simon) would look at it and call me back. I received no call and called on the 1st with the same responses. Today (2nd July) I got Simon who tells me that the report is showing on the portal but when he went to open it, it was not there and he would chase the engineering firm and get back to me in a couple of hours.                     I believe I am being taken for a mug now and am unsure weather I should escalate my revolver case to the regulator or any other advice, I'm therefore at this forums mercy any advice will be greatly received. 
    • Yeah I think you're probably right. I cancelled it anyway because the balance was due on the 10th July and I thought if I held out for an alternative and rejected it I might loose my deposit. Virgin are not answering calls from anyone not flying within 14 days by which time  the balance due date will be well past. I didn't want to pay the balance just to keep my deposit and get it all back in 4 months. Better to cancel the whole thing and get my deposit back now.   The holiday is in October so I think it will be fine to travel by then. I still plan to take a holiday on the same dates but I doubt I will get 10 days in the Caribbean (or anywhere long haul) for the same price so will probably go somewhere in Europe. It's just frustrating when I see basically the same holiday advertised on the same dates but for 50% more than the one they just cancelled.   I'm not too worried about Covid 19 and plan to travel as soon as the quarantine rules are lifted.

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

Hi all,

 

My boyfriend and I joined Xercise4Less in our final year of university. The gym opened in November 2014 and the first payment was taken in December 2014. Before joining, we triple checked that we could cancel upon relocating, I.e. when we moved back home. We checked this with the salesperson and in the contract. There isn't a gym within 15 miles of us, so we could cancel within the years contract.

 

Our last assignments were in at the end of May, so towards the end of April, we both sent emails using a contact form on the website to notify them we would be cancelling in a month due to relocating back home from university. Unfortunately, we didn't get a confirmation email to say the email had been sent or anything. However, shortly after, I double checked with a staff member at the gym, who said that would be fine and we would be contacted if they needed anything else.

 

Towards the end of May, the last direct debits were taken and we then cancelled the direct debits. Following this, we moved back home and heard nothing until August of this year, when we received letters to our home addresses regarding an unpaid debt to X4L from CRS.

 

I now know it was stupid but I called them up to explain the situation and was told all I needed to do was send proof of our addresses I.e. driving licences. I sent them photocopies of these and then received an email to say these had been received and we no longer owed a debt of £19.98, which had accrued after the proof had been sent. However, we apparently still owe £182.47, which was already due before the proof had been sent. They said they would accept a discounted sum if we paid in 7 days etc etc.

 

Unfortunately, I'm not sure what to do next. I really don't think we owe them anything as we gave them 1 months notice and clearly stated from the start and at the time, this was due to relocation from university. I find it so wrong that X4L didn't try to contact us once before CRS came into the picture. I know we changed addresses but they had our emails and telephone numbers (We still get promotional emails and texts from them).

 

Just to make it clear, it's the exact same situation for my boyfriend and I.

 

Help please? It would be very much appreciated.

It sounds like you did all that was required of you.

 

You gave a months notice and paid the next DD payment, and then cancelled the DD mandates.

 

1. Do you have copies of the emails that you sent to X4Less.

 

Harlands/CRS have no right to say you can only cancel from when you provided proof of change of address.

 

They have no authority to demand in the way they do and you should ignore them soon.

 

Answer my Q above and we'll take it from there.

Hi all, thanks for the responses.

 

Unfortunately not. I used a contact form on the site and expected to receive a confirmation email to say my message had been sent but nothing. However, when I spoke to CRS, the issue didn't seem to be around the months notice. It was due to not providing the proof of change of address when I gave notice.

It doesn't matter that you don'r have a copy of the cancellation notice. They are famous for "losing" or failing to process cancellations.

 

Harlands/CRS will no doubt continue to make demands for increasing amounts because they add their admin fees as time passes. However, they have no authority and can't do anything. They won't take court action because they have no grounds.

 

I suggest you each write to Harlands saying :-

 

I cancelled due to relocation and paid a months fee for the notice period.

 

I will not pay you any more and if you continue to make any demands, I will make formal complaints to The CMA and to Trading Standards.

 

Send this by post and get a free Certificate of Posting at the PO Counter as proof of posting.

I have had multiple calls and texts but no response to my letter. However, I have had a letter from CRS threatening court action unless I make payment in a set number of days.

 

Should I send another letter??

You can ignore their silly little letter, they don't do court because they know they would be laughed out of it, so don't worry on that end.

 

Pointless IMO in sending them another letter, you're just playing their dumb game of letter tennis.

 

Make a formal complaint to the gym informing them that you are holding them ultimately responsible for the actions of their chosen tin pot DCA, and that due to their continued harassment, you are seeking legal advice with a view of taking action against them for the criminal offence of harassment.

 

Complain to the CMA and TS regarding the harassment too.

 

Keep a diary of events regarding the calls/texts.

 

Forward the text messages to 7726 (spam on your keypad)

 

When they ring laugh and hang up.

Hi all,

 

Apologies for the lack of contact from myself. I hadn't heard anything from them for a while until around a month or two ago, when I started receiving calls and texts from them. I ignored all and blocked their number. I've also moved address in this time, however, still receive letters at my old address as its my parents house. On my last visit, I discovered two letters - none responding to my letter but stating my account was to be passed to an external debt collection agent and that I should call them to make payment etc.

To be honest, I completely forgot about them but today I have received a text from Spratt Endicott asking me to call them.

 

Should I speak to them and explain the situation or write another letter?

Embarrass them on social media too.

On going home, I saw I had received a letter from Spratt Endicott dated 8th August and asking me to contact them within 7 days regarding what I owe. Should I ignore?

 

I did actually send an email to the manager of the gym I was at with a complaint back in November 2015, no response at all. I will proceed to put in an official complaint once I figure out how - seems to be nothing on their website to allow you to do this.

I just wanted to update you on what I think may just be a victory - I complained to Xercise4Less and this is the response I have just received:

 

 

Thank you for your email

 

 

Your membership has now been recalled from CRS and cancelled, and they will no longer pursue for outstanding arrears.

 

Please accept our apologies for the inconvenience this matter has caused you.

 

 

I have no idea on whether this means it will all stop but I really hope so!!!
