      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

So is the claim to date the date the PPI was last paid or the card was paid off?

If the `claim to` date is set at 05 /09 then this reduces the total to around £5864 which doesnt seem that much????

Would £5864 be the total of the claim?

SO last PPI payment was 05/2009 and card paid off on 2/12/2010 which gves a figure now of £7569.00

I dont understand ,not sure what the loan has to do with claiming the PPI on the card??

I have a query/complaint in with the FOS about the way they`ve dealt with loan to pay off the credit card balance , not sure what they will do .Both TSB (who never bothered replying ) and LLoyds didnt respond to my complaints ,only kept sending me a PPI questionaire and going on about PPI.As if they couldnt read my letters.

 

p.s the loan they got her to take out to pay off the card didnt included PPI but they got her to take out life insurance through Scottish Widows to cover the loan.

you've just worked out that £5864 of ppi was within the sum you took the loan out for yes?

 

 

so you got charged interest at the loan rate on that didn't you?

nope

because that PPI figure only runs till the day you paid it off with the loan.

 

 

so £7569 was rolled into the loan had interest added to it yes....

Still confused,

also note that despite my mother thinking the card account was closed ,it wasn`t it had sat until at least 2013-2014 showing on her online bank account unused with a credit balance of £0.68 credit limit of £200.

 

Recently not sure when but this card account suddenly has a different account number.(and NO she hasn`t asked for any cards).

 

I`m disgusted with the whole situation,(taken advantage of ) of card and loan

and i`m trying to get as much back for her as possible.

 

Shes really struggled and this loan

 

At £299.00 a month plus the £20 life insurance has wiped out her state pension.

 

She has to get by on a small works pension which is less than the state pension

and rely on my father(who really old school and has never applied for credit as far as i know,

apart from the mortgage to buy their house)

,who incidently knows nothing of this matter.

 

So reading that thread,

 

if the loan was for £13000 , PPI claim for card is £7579.

 

So PPI claim of £7579 is 58.2% of £13000 or £174.02 of the monthly £299.00 loan repayment.

Is that what your refering to???

 

The loan rate is 23.5 % i think.

 

Does the card account still being open in 2013-2014 make any difference to the "claim to" date on the Card PPI calculation?

She has paid £17691.00 so far at £299.85 at month 59 with 25 months to go.

£7496 to still pay.

She has paid £1142.83 life insurance Scottish Widows for this loan at £19.37 a month ,with another 25 months at £484.25.

the claim to date will be when ever they stopped charging interest.

as the balance [containing the PPI you are reclaiming] was paid off

it will be that date.

you enter £174.02 on every date she has made a payment [her normal £299 one]

 

then that's take care of the extra int from the loan that been added.to the rollover PPI

that sounds alot more like we were expecting money wise.

 

 

I`ll do the stat interest sheet though i`m not certain of exact dates of each payment usually on or around the 4th of every month.

 

What about the life insurance how will that figure in?

Hi DX,

Im having an awful time with the FOS trying to get them to understand what i`m claiming here. One of their advisors has split the case into two different ones one for the card and one for the loan.

They keep sending emails saying as there is no evidence of PPI on the loan we might not be able to help.

Ive sent all the details about the situation, taking advantage of my mother , ,etc... Leaving her with no money... spreadsheets for the card PPI carried into the loan but they dont seem to understand what im talking about.

I really dont want to mess this up.

I put in a further questionaire concerning an earlier loan PPI to LLoyds on behalf of my mother .

 

 

We filled in the form giving me permission to deal with the claim.

 

 

Do LLoyds have any right to ring my mother and ask for loads of details ,

when she can hardly remember what she did yesterday.

 

 

Surely if its put down on the form that i am complaining on her behalf

then surely any correspondance should be made with me???

She is not capable of complaining on her own.

 

She was on the phone for 1/2 hour and can`t hardly remember what she told them or what they asked?

Im fuming about it.

I specifically told her that if they ring to just tell them to contact me as i am the one dealing with it and then put the phone down. But shes too polite !

 

We have put in a formal complaint to Lloyds ,also telling them that we want anything that was discussed or said to be disregarded as she is not capable of answering the questions.

We asked for this to be confirmed in writing.

 

And they have also just sent a letter today still claiming that the card which is the subject of this thread doesnt appear to have had any PPI attached to it.

and so they have closed the case.

 

I got straight onto the ombudsman as they sent a similar letter a few weeks back .

I included in the email to the ombudsman scans of three statements one from 2002.

one from 2005 and one from april2009 the month before the ppi was cancelled.

 

Is this typical behaviour from Lloyds

,how can they deny it as the whole of the statements barr the very first one from the period were included in the SAR request??
