    • Hmm yes I see your point about proof of postage but nonetheless... "A Notice to Keeper can be served by ordinary post and the Protection of Freedoms Act requires that the Notice, to be valid,  must be delivered either (Where a notice to driver (parking ticket) has been served) Not earlier than 28 days after, nor more than 56 days after, the service of that notice to driver; or (Where no notice to driver has been served (e.g ANPR is used)) Not later than 14 days after the vehicle was parked A notice sent by post is to be presumed, unless the contrary is proved, to have been delivered on the second working day after the day on which it is posted; and for this purpose “working day” means any day other than a Saturday, Sunday or a public holiday in England and Wales." My question there is really what might constitute proof? Since you say the issue of delivery is a common one I suppose that no satisfactory answer has been established or you would probably have told me.
    • I would stand your ground and go for the interest. Even if the interest is not awarded you will get the judgement and the worst that might happen is that you won't get your claim fee.  However, it is almost inevitable that you will get the interest.  It is correct that it is at the discretion of the judge but the discretion is almost always exercised in favour of the claimant in these cases.  I think you should stand your ground and don't give even the slightest penny away Another judgement against them on this issue would be very bad for them and they would be really stupid to risk it but if they did, it would cost them far more than the interest they are trying to save which they will most likely have to pay anyway
    • Yep, true to form, they are happy to just save a couple of quid... They invariably lose in court, so to them, that's a win. 😅
    • Your concern regarding the 14 days delivery is a common one. Not been on the forum that long, but I don't think the following thought has ever been challenged. My view is that they should have proof of when it was posted, not when they "issued", or printed it. Of course, they would never show any proof of postage, unless it went to court. Private parking companies are simply after money, and will just keep sending ever more threatening letters to intimidate you into paying up. It's not been mentioned yet, but DO NOT APPEAL! You could inadvertently give up useful legal protection and they will refuse any appeal, because they're just after the cash...
    • The sign says "Parking conditions apply 24/7". Mind you, that's after a huge wall of text. The whole thing is massively confusing.  Goodness knows what you're meant to do if you spend only a fiver in Iceland or you stay a few minutes over the hour there.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Jafy and welcome to CAG

You need to keep all communication by letter only, so you have proof of what's said by either side. Unless you record calls, you have nothing.

I've not heard of BC sending staff out to meet card holders before but, if this happens, record the conversation. See here - http://www.consumeractiongroup.c%20o.uk/forum/showthread.php?439552-Guidance-note-Dealing-with-Customer-Service-Departments-**Correct-at-Jan-2015**

Also, the bank should always refund you any amount you challenge as per FCA regs - https://www.google.co.uk/url?sa=t&rct=j&q=&esrc=s&source=web&cd=3&cad=rja&uact=8&ved=0CCgQFjACahUKEwiN9s3wmJHJAhUCsxQKHWWXDk4&url=https%3A%2F%2Fwww.fca.org.uk%2Fconsumers%2Ffinancial-services-products%2Fbanking%2Fyour-rights%2Funauthorised-payments&usg=AFQjCNE62LtGkMmqN7pLoo5rphOtoXsXvw

It sounds like BC recognised these as fraudulent transactions but they're trying to dodge their responsibilities.

Many thanks I have asked for a letter confirming of who's going to attend and what they going to talk about!!! I've received the letter today and it confirms meeting will be in my local branch with a senior investigation officer and person I was dealing with originally!!! Al it says in the letter is time and confirming it will be a meeting and nothing else!!!

Is this normal do I have to go to the meeting?? Why after nearly 4months tho??

I don't know if its correct but I had a dispute with an online gambling site. They debited my card more times than I had asked them too. When I contacted my bank (Barclays) they said that the Visa regulations do not cover gambling companies. They said there was nothing that they could do. Good luck.

Where my mother was not even in the country!!!

I am prepare to answer any questions as I have already given them 2 statements!!!

But why the meeting that's what I don't understand

Hi Jafy,

I am prepare to answer any questions as I have already given them 2 statements!!!

Did you mean to say you are NOT prepared to answer questions ?

If you fail to co-operate with them, they may suspect you're involved in the fraud.

They may add the transactions back to your a/c and you could end up with a CIFAS report against you. This could be detrimental to your credit rating.

You should use the meeting to ask THEM to confirm what suspicion or evidence they have to consider your version of events to be questionable. Read up about their obligations to refund from the link I posted.

After you had the call on 11th Aug at 23:30, was it just 2 hours later that you called BC or was that a later day.

Ah, ok.

When you go to the meeting, it's been suggested that you should take someone with you.

Not to intervene in the interview at all, but to witness and make notes.

The BC rep may not like this but I'd insist on it happening.

Nope person who's dealing with the case will be coming with his senior invitigator, and it does not say if it is caution+3 all it says is a meeting!!! Are they obliged to tell me if it is caution+3 and should I take someone, thanks for your help and I have spoken to fos and will be making a official complaint after this

Hi Jafy,

I very much doubt it would be an interview under caution as no one at BC has the authority to do this.

I suspect it would be a meeting/interview with someone who does this often. Take care not to be intimidated or get angry.

If there is any mention of this being an interview under caution, I'd decline and come back here to seek advice.

Why did you authorise the transaction when they sent you an SMS? Didn't raise alarm bells seeing £3500 going out of your account?

How did you manage to prove you don't gamble?

If someone was going to use your card to deposit money, why did they use your email address too? Did you already have an account with the company? Sorry, but this doesn't make sense., and I can see why the bank is acting this way.

This does all smell a bit fishy.

I have never gambled I've given my all my bank statement to them to prove that I don't gamble!!!

I really don't know why it was a genuine mistake to which I understand myself and it does look bit well more then fishy!!! But it wasn't me, I have never had gambling site before and is the first time!!!

All I could think is email was hacked into as they had all my details everything!!

Yh they have, I've logged into my account and seeing over 9emails from the gambling site one says thanks for the verification.... And the rest was confirmation of amount withdrawn!!!

I really don't know what to do and scared as is stressful I have never ever had any problems with banks or anyone so really don't know what to do!!

I am no expert but this sounds like you have a virus on your PC that is redirecting your searches

I once had every contact in my hotmail account spammed with offerers for that male enhancement blue pill

The microsoft response was simply to change your hotmail password

Gambling sites like porno sites are a hotbed of Mallware programs, you probably got it by opening up an innocent email containng the Malware

Might i ask what Anti virus AND Anti Spyware programs do you have on your PC

Any calls from 'Microsoft' about a problem they 'detected' on your PC and need to connect to it urgently?

Or have you filled in any forms from websites which asks pretty much all of your details? They may look legitimate, but can be phishing sites. Perhaps from your bank / paypal?

Hi Jafy,

If you use the computer online for browsing and particularly if you use it for any online banking, you MUST have Antivirus and Antimalware protection.

Which? Magazine rates Kapersky Internet Security 2015 highy at a cost of just £26 and it scores 80% on Which's review. Or the best free Antivirus is AVG rated at 71% by Which.

if you aren't competent or confident about this issue, get advice from a Techy friend or go to a local PC shop that local folk recommend to you.
