    • Hi all, I purchased a car in January from Big Motoring World Leeds. At the time of sale I was shown a tab on the salespersons computer marked 'service history' and I was able to take comfort knowing that the car had been serviced on 3 occasions as the date, mileage and company was there on screen. Being a 3 and a bit year old car that, in my mind, constituted full service history 🤷‍♂️ Anyway, collected the car a week later. Once home I settled down to through the book pack etc. Opened the service history booklet and it was completely blank. In addition there were no invoices detailing that any services had been done. I duly contacted BMW and asked them to supply me with proof of service history. They responded saying that on their 'vehicle documentation checklist' I had ticked and then signed to the fact that I had seen the service history and that I was happy with it. I dug out this checklist and what it actually states is 'seen service history online' which I had in the showroom. BMW seem to think that this satisfies their responsibility in providing service history. The reality is that I don't have any proof that the vehicle has ever been serviced! For my own peace of mind I ended up paying for a service that satisfied the manufacturers maintenance schedule to the tune of £330. I even complained to the finance company that the vehicle contravenes the Sale of Goods act 2015 as l, in effect, ot is not as described. Amazingly they weren't interested and instead I just got an email stating that it's not illegal to sell a vehicle without service history and that servicing costs were part and parcel of vehicle ownership. I've since complained to the ombudsman and am awaiting to see if they can help. I have no issue with the car but the treatment and customer service has been the worst I've ever experienced. I don't really know what to do next as I really do feel aggrieved that I've had to pay to service a car that should have already been serviced. Can anyone point me in the right direction please? 🙏

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I was/is on SEETEC, but my doctor told them that I was travel sick, they've given me 3 sets of tablets to help me. I do 9-5 job search which is 5 days a week, Thursday and Friday I go to a city 45 minutes away via bus.

They knew I was travel sick, but ignored the doctor's note, I wasn't well.

On Monday I was ill and kept retching, I told the receptionist that I felt ill but had to wait for the manager.

Well, she came back and told me I had to stay at tehe centre till 5pm, it was 12.30 and my stomach wa shurting and I felt sick. So I walked out and had a doctor's appt and he gave me the 7 day sick not which has ran out.

 

Because I have now got the month long one I can sign off JSA and onto ESA..

I'll ring them on Monday, but I don't understand if I have to continue with the job search or ring SEETEC to tell them I won't be in. I will on Monday as they need a copy of my sick note.

 

Can anyone help me? The doctor wrote down anxiety as cause for me being off sick. He also said this place is stressing me out and making me ill.

I would gladly get myself a volunteering placement myself.

While on ESA you don't have to look for work. Also, you do not have to participate in the Work Programme unless you have an assessment and are placed in the Work Related Activity Group. If you only anticipate being on ESA for a month, that's not likely to happen.

Well, if your doctor is prepared to issue sick notes then you can remain on ESA until you have your Work Capability Assessment. After that, continuing to claim ESA will depend of the result of the assessment.

If your doctor says you are not fit for work then you should be able to claim ESA. As to PIP, you would need to meet the conditions for that separately - it is not related to ESA. Information on PIP, including the descriptors, can be found here.

To be entitled to PIP the condition must have existed for three months prior to the date you claim, and must be expected to last at least another nine months.

Well the doctor thinks that my stress is related to what SEETEC is doing to me. But I've only been disgnosed with this for about a month or so. I estamate the date was around 20-30th of October. I saw a doctor who gave me a sugggestive sick note on the 30th which SEETEC ignored. Yesterday my doctor said they shouldn't have done that.

To claim PIP, because it's a recent thing, they may ask that you provide evidence to prove it's an ongoing thing that will last for at least another 9 months. You'd have to score at least 8 point on the daily living or moving around parts to get anything.

I'll have to ring them on Monday because I don't know if I can get ESA even if I do have a sick note. The doctor told me I am not fit for work. My mum is wondering if I can get PIP for anxiety.

 

I claimed ESA for a year with anxiety… was also allowed to do a small part time job of a few hours a week… I think you can do voluntary work, too.

 

My GP gave me 3 monthly sick notes.

 

Not sure about PIP, though.

My brother has a 6 month sick note and still volunteers at the place he has been doing for 5 years. He has Hearchsprungs desease (a bowel dease). But doesn't claim PIP.

I'll just stay with ESA, I got a letter to see my adviser on Monday, don't know whether this is about the 7 days sick not or not, but I'll bring the one month sick note too.

I just hope she doesn't have a go at me for not going to SEETEC, she wanted to know how my parents are helping me get into work.

And if my Dad could of drove me to the placement place, he's retired but has to drive my nephew to school.

Yes, you can work while claiming ESA - it's called "Permitted Work" and there are limits to the number of hours you're allowed to do. It's also permitted to volunteer, although obviously you should not be doing anything that your condition would affect, if you see what I mean.

 

PIP is paid based on meeting the appropriate descriptors, and you can receive it whether or not you are working.

I had an appointment at the Job Centre, I had been sanctioned but because I have now signed off onto ESA I don't get next week's pay.

I have claimed ESA now, but I don't know when to expect my first payment. And my adviser said 'I haven't seen you for long, but from what I see, you are creating obticles to prevent you from working' which is not true. I wanted to volounteer. She also said that after claiming ESA and if I ever go back to JSA I should expect to go back to SEETEC!'

They are creating this stress for me and I shall not go back, I will get myself a placement of my own.

 

 

If there is any more help you can give, please say so. Because I've never claimed ESA or know the rules.
