This morning I had a phone call from an Enforcement Agency who had been to my old address.

They want almost £500 for a traffic ticket where they said I went into a bus lane last May.

 

 

Obviously I cant remember and they said they are going to post me some papers out as I live in a different town now.

 

 

I did give DVLA my new address and its on two MOT's since but apparently its not updated on the system.

I know its on my credit report.

 

Can anyone please tell me how I can fight this as I dont have the money to pay

and they say it has been to court and finalised and now I have to pay

and they are talking about taking my car away if I dont.

 

 

Worse thing is I am disabled and cant get around without the car.

 

 

Really stressed and worried now as never had to deal with anything like this before?

So you updated DVLA with your new address for the V5 registration document ?

 

Is your car a disability vehicle ?

 

If you did not update the registration address, there is probably not much you can do.

 

 

If they prove the offence, you will have to come to a repayment arrangement with the enforcement company.

I sent a form to them about a year ago but it looks like its not processed.

 

 

The MOT's contain the new address as well and the road tax is paid from this address as well.

 

 

The car is not adapted for disability but I am registered disabled.

 

 

I even received a form here to claim rebate on the disability tax part but havent done it yet as been really ill.

You need to ask DVLA about them not processing the V5 registration change properly.

 

 

If they find an error in their processing, you might be able to claim back from them any additional sums you will have to pay, because their error stopped you paying the penalty earlier, therefore avoiding enforcement costs.

 

Because your car is not a disability vehicle, it would be at risk, if enforcement officers visited.

 

 

So if you have a garage you can lock it away in, that might be wise.

 

 

Be aware that if they have your new address, they may now visit without warning.

sounds like a Out of Time late Statutory Declaration time me thinks

 

 

give the relevant council enforcement a ring and tell them what has gone on.

 

 

if the DVLA failed to update your new address

and it was done before you got the ticket and after you had moved

then that's the dvla at fault here

nothing unusual sadly

they lose 1000's of documents a day.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Are you the registered keeper, if so, have you the V5C with your current address on it? If you have, the date near the bottom of page 2 will be when the DVLA updated their system.

If the bus lane process is like the parking one, and I suspect it is,

then all this emphasis on when the DVLA updated their system, and whose error it is, is pretty pointless.

 

Unless the legal documents were served on the debtor, then he will have grounds to contest it through the stat dec process, whoever is to blame for the address issue.
