Almost 4 years ago I signed up with a CMC to use section 77/78 of the consumer credit act to make 2 credit card debts unenforceable.

One with Capital One for just under £2k and

one with Mint for £1k.

Both are now defaulted,

regret doing it now but it's done.

I hadn't heard anything for a while

now I've had letters from Cabot saying they've bought the debt from Capital One.

I'd normally send this onto the CMC but have just found out they went into administration.

I need some advice from anyone that's been in this situation please or dealt with these companies.

Should I contact Cabot, arrange a payment plan,

try and negotiate a reduced settlement?

Can anyone supply me with the type of letter that CMC would've sent out?

Also, I've changed address and moved back into my parents house for now.

I still get my mail from my old address.

Should I tell Cabot I've moved?

Will my parents address be affected by my debt?

For info, I live in Scotland if that makes a difference to anything.

Any help would be much appreciated.

Thank you.

time to send cabot a cca request

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

As you are in Scotland different rules apply. When was you last payment?

My last payment to capital one was about 4 years ago. I've never paid Cabot or any collectors.

I sent any letters to the CMC and they dealt with them. With them no longer there I don't know what to do.

time to send cabot a cca request

What's a CCA request and what would it do? Thanks for the reply.

Ok I know what a CCA request is, yeah I thought that would be my next move.

Is this the right road to go down?

I guess I'm already well down that road already!

CMC? Claims Management Company?

Post #1 has been edited by the OP to remove the name of the CMC.

Hi dx, thanks for the reply

I have no intention of filling in the budget request sheet. Should I just wait until they respond about the CCA request? If Capital One were unable to enforce this then surely Cabot can't?

I've read threads. Just want to know that I'm going about things the right way. The CMC was dealing with things like this on my behalf previously. As mentioned earlier, any help or advice is much appreciated. Thank you.

sad fact is most of these CMC's are run by ex DCA employees

that saw how easy it was to fleece people etc etc.

everything they can do

you can do for free

without having to pay the middle men

that if they secure payment out of you usually take a cut too..

Yeah I should just have done it myself. I'll keep the thread updated with any contact I get from them.
