Greetings

 

Since the last talk talk data breach I have been having nothing but phone calls from people pretending to be talktalk with most of my personal details to hand. When I have been declining their services I have been called all manner of things - Insert Swear Words Here!

 

I am still in my contract but what is the likellyhood of me leaving them and sueing them for loosing all of my data.

you would need to prove this has been caused by the breach

Sadly Talk Talk will want to have 'proof positive' these calls were generated using data 'misappropriated' from them before anything may be done.

 

Going by Talk Talk's track record in NOT dealing with a simple query expect a very long and protracted series of correspondence.

We have had four telephone calls from people stating they are from Talk talk, in the last week alone, I just say the following... I WILL END THE CALL HERE AND CONTACT TALK TALK DIRECT TO CONFIRM WHO YOU ARE.... The line soon goes dead..... The last call was today at 15.07 I just laughed down the phone when she asked me to confirm the account holder and disconnected her.... Hopefully they will soon get sick of trying, we are too wise to fall for what they might be wanting to achieve. Just end the call and if you really want to be sure, ring talk talk yourself, but try use a different phone in case these callers are still on the line.....

!2 years Tesco distribution supervisor

7 years Sainsburys Transport Manager

 

4 Years housing officer ( Lettings )

Partner... 23 Years social services depts

 

All advice is given through own opition, also by seeking/searching info on behalf of poster, and own personnel dealings.

Well I shall be writing a complaint to them shortly which I shall post on here. I am really angry. One of the bwords just called my wife something really nasty.

Thanks for this. I am now with the communicatons ombudsman and am waiting to hear from them regarding my case. Ill keep you updated as it goes

Was this a first tier adjudicator or Ombudsman proper, decision ? If the former, then ask for your complaint to be escalated to the Ombudsman proper.

OK I have on more question. I am not interested in damages. I just dont want to be with this company anymore. So if I am able to prove that they did not execute reasonable care in safeguarding my data which subsequently proves they are in breach on contract; where is the law to support me leaving with no penalty.

Talk Talk themselves have said that you can leave without penalty if you can prove to them you have suffered. This is not good enough IMHO.

 

My contract with them runs out in May and I am leaving them next month and going to EE - will cost me £69 but I will get that back when I put in a claim for their non-payment by DD charges, 'not paying on due date £10 charge' and hassle they caused me with billing me for a phone I have never ever used and they should have taken off my account a long time ago.

 

I will wait til I have changed before doing them a 14 day letter of action - I won't need to pay for court fees either as I am currently on benefits so I can afford to carry this forward.

im lining up a new isp tomorrow. It already has gone to directors office at talktalk and then the ombudsman

Talk Talk have just sent me an email saying something has gone wrong with my digibox (which is NOT true) and I have to call them to get the courier to deliver me a free new one.

 

I also have had a letter from them saying I won't get

 

Free call blocking etc (I never use the phone line anyway so no loss to me!)

Access to Sky TV online and other pay monthly services (I already get them via the Amazon Fire stick and PS3 box)

 

amongst other things.

 

Something is very wrong with that organisation!
