Hello

 

 

I have two Student Loans dating from 1995 and 1996 that I took out whilst at Aberdeen University. For many years I deferred them with the SLC with no problems until 2011.

 

 

In 2011 whilst self-employed they refused my deferral due to the chap that I was sub-contracting for not writing the letter regarding my income on headed notepaper.

 

 

I probably had some communications from them which I ignored as this was during a spell of depression and ignoring my debts.

 

 

Back to present time, and this week I have received a letter from a company called Thesis Servicing (only has the 1995 account number on the paperwork) advising me of there intention to register defaults for over £3800. (this must be both loans combined.) There is also a letter that appears to be a default notice.

 

 

I am still on quite a low income, what shall I do? I was hoping that after 20 years the sums may be written off. I really don't want a CCJ, is it best to see if they will accept a low monthly payment?

I wondered about that but although they didn't accept the referral I'm sure that they would accept the letter as acknowledgement of debt. I did wonder if it being taken out in Scotland would it be the five years? I'm from England however.

If you were resident in Scotland when you took them out

It's 5yrs. Debt is then extinguished

I haven't contacted the SLC since my referral of 2011 and have never contacted Thesis. I was living in Scotland whilst a student there and must have used that address for correspondence.

 

 

If I just ignore them are they likely to take me to court or is this letter very common with them?

 

 

I'm very surprised that they have not defaulted me before now.

were you living in Scotland [had been living there for more than 3mths each time]?

 

 

if you were not

then English rules apply

Not sure of exact dates, but would the onus be on them to prove those dates? It's a big worry I didn't need after so many years. Shall I send a SAR to SLC?

 

 

Been reading some old posts on here and they seem pretty regular with issuing court claims.

 

 

Do the SLC still have all the paperwork from 20 years ago?

Would be up to Link to prove anything if you dispute it.

 

However, SLC unlike many commercial firm, did generally retain the paperwork or copies of it - copy agreements etc, and have a service agreement with companies who bought the debts to supply copies on demand.
