    • Thank-you dx for your feedback. That is the reason I posted my opinion, because I am trying to learn more and this is one of the ways to learn, by posting my opinions and if I am incorrect then being advised of the reasons I am incorrect. I am not sure if you have educated me on the points in my post that would be incorrect. However, you are correct on one point, I shall refrain from posting on any other thread other than my own going forward and if you think my post here is unhelpful, misleading or in any other way inappropriate, then please do feel obliged to delete it but educate me on the reason why. To help my learning process, it would be helpful to know what I got wrong other than it goes against established advice considering the outcome of a recent court case that seemed to suggest it was dismissed due to an appeal not being made at the first stage. Thank-you.   EDIT:  Just to be clear, I am not intending to go against established advice by suggesting that appeals should ALWAYS be made, just my thoughts on the particular case of paying for parking and entering an incorrect VRN. And, I also continue to be grateful for any advice you give on my own particular case.

    • Yeah, sorry, that's what I meant .... I said DCBL because I was reading a few threads about them discontinuing claims and getting spanked in court! Meant  YOU  Highview !!!  🖕 The more I read this forum and the more I engage with it's incredible users, the more I learn and the more my knowledge expands. If my case gets to court, the Judge will dismiss it after I utter my first sentence, and you DCBL and Highview don't even know why .... OMG! .... So excited to get to court!
    • Yep, I read that and thought about trying to find out what the consideration and grace period is at Riverside but not sure I can. I know they say "You must tell us the specific consideration/grace period at a site if our compliance team or our agents ask what it is"  but I doubt they would disclose it to the public, maybe I should have asked in my CPR 31.14 letter? Yes, I think I can get rid of 5 minutes. I am also going to include a point about BPA CoP: 13.2 The reference to a consideration period in 13.1 shall not apply where a parking event takes place. I think that is Deception .... They giveth with one hand and taketh away with the other! One other point to note, the more I read, the more I study, the more proficient I feel I am becoming in this area. Make no mistake DBCL if you are reading this, when I win in court, if I have the grounds to make any claims against you, such as breach of GDPR, I shall be doing so.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

According to the forecasts, we will either have one of the coldest winters on record with ten feet snowdrifts or a very mild gentle winter with very few cold spells.

 

In other words the forecasters don't know. The ones who sell stories to newspapers are claiming the 'killer' extreme winter and the ones who just study the science without selling stories claim it will be very mild. I tend to therefore believe the latter, as they are not forecasting to generate media headlines.

 

Some of the bookmakers have cut odds on a white Christmas because people have been placing bets because of the media stories.

I have a suspicion that the warm waters in the pacific are to do with under water volcanic eruptions. The water temperatures are well above normal. But the waters around the UK are also warmer, as cold water fish are now increasingly moving north of Scotland. So it may be that there are also underwater water heating issues closer to home. There has been an increase in sightings of deep water fish species, possibly being driven nearer to the surface by issues in the deep.

Just remember how much the temperature of the sea impacts on this country.

Quite right.

We will see stormier cloudier but generally less cold weather due to the extra energy going into the systems near us - including the gulf stream.

 

Drier countries/zones will see the more traditional warming - Like Australia and parts of the US getting temperatures which kill people and which you would not even have expected in an unusually hot season in the middle of the Arabian desert.

 

Extra heat = extra energy, not necessarily more sunshine.

Global warming = super storms, tornadoes and hurricanes in many areas, alternating droughts and floods in others, and major erosion everywhere.

I've based my life on that forecast and emigrated to England only to find out that they were wrong.

I'm not an expert, but I haven't seen any effect of this man made global warming.

Instead I have seen documentaries explaining that the earth goes through phases of warming and cooling on a regular basis and has done so for billions of years.

No, hung on: The earth is only 10 thousand years old accordingly to some.

I think the Earth is affected by forces from outside more than anything Humans have done. The intensity of the Sun, gravitational forces of the Moon and other forces scientists may not be aware of. There have been many recent discoveries by those who study astronomy. They believe that there are now asteriods which can come close to Earth, which are not detected until about 20 days before they appear in telescopes. There is some talk of other planets having a direct effect on the Earth.

 

Global warming through burning fossil fuels is just a small part of a much more complicated mix of issues.

You have seen info-mercials funded by the petroleum lobbies rehashing and spinning facts. The vast majority of real climate scientists (97% see links) now clearly believe that man made climate change is both a reality and a real danger.

 

 

The earth does go through periods of heating and cooling BUT consider this,

 

The Earths current cycle should be causing a period of cooler weather, yet is registering record high temperatures

 

These temperature variations in the Earths cycles generally occur over thousands of years (or at least hundreds), not a few decades - or even years as seems to be occurring now.

I'm more inclined to believe what unclebulgaria said.

After all the same people who profess global warming are taxing us for utilities that cost pennies making a great profit

 

With due respect to unclebulgaria, I think the researched opinion of 97% of trained climate scientists (backed by all major REAL scientific institutions eg NASA, WHO) holds more weight.

 

Only God's opinion should outweigh that, so the only other option is that the world is 4000 years old and God waved his wand to create oil as a punishment for mankinds evils, and the rapture is upon us.

Mankind is wrecking the planet, but this has been the case for a long time. My biggest concern is deforestation, which is removing the lungs from the world and will lead to infertile soil conditions, so less space to grow food. Look at the amount of burning back of forest areas in Indonesia at the moment, as they seek space to plant more palm oil trees. They will knacker their own environment to make money and regret it in the years ahead. It is proven that if you remove the natural forestry that you upset the whole ecology of areas and you end up with soils that are poor for growing food crops.

 

The planet is heating up, with polar zones melting. This is caused by internal and external planet issues. It is one complicated mix of things.

 

If you want to make the situation better, get planting trees, quicker than they are being ripped out of the ground. If they don't stop what they are doing, then you will end up with a planet that is a mess to live in.

Planting trees is a darn good start. Not only are they large carbon sinks which also generate and clean the air we breath, they also prevent soil erosion in the increased rain and storms.

Planting trees is a good idea but when in Brazil an area the size of wales is being destroyed every day pales into comparrison.

 

You then have the two biggest poluters on the planet Uncle Sam and China sticking two fingers up at the Koyto climate change Protocol

 

What did the UK Government do? Siezed the moment to raise Green taxes in the name of climate change to fill the treasury.
