    • I would have thought it easier in small claims.  Your wife very kindly and considerately wrote to her employer offering more notice than she was obliged to do.  No doubt she had the best interests of her employer in mind and wanted to give them adequate time to plan ahead and find a replacement.  To her amazement, her employer took advantage of her kindness and unreasonably treated her notice as taking immediate effect, blah, blah blah.   Personally, I think an argument like that is quite likely to succeed in small claims where they won't be accustomed to arguing the niceties of employment contracts.  It's obvious your wife is being taken advantage of.   Again, I think you are more likely to get an even-handed and fair hearing in small claims than at an ET.   However, I'm not a lawyer and I'm definitely not an employment lawyer.  See what others advise and whether anybody else thinks it would be easier and more likely to be successful simply to sue.  (Oh - and remember if you want to sue them for the money you've got six years to do so, whereas the time limits for ETs are ridiculously tight.  Can't remember off the top of my head but is it something stupid like 60 or 90 days?  Ridiculous).   Of course there may then be issues about getting future references from them.  But if you go down the ET route that'll likely be a problem anyway.    
    • say i was going to write to all these about the debts and try get deal to reduce monthly payments and stop all interest do I write to them first or do I stop payments then write to them ?   Same if I was going for a DRO do I just sort out and apply for that first or stop all payments then apply for it .   Also I see for a DRO it says ive got to go through  an authorised debt adviser so who do i go to about this and at moment we still on lockdown here in wales and not many places open .   Last off ive asked regarding pro rata forms and still cant find any 
    • Yes but I think in a small claims court it will be far harder to prove. I have plenty of evidence to discredit the Director but again it could still not be enough.   She will be a month with no money and I think it’s far more risky than a tribunal where this action alone could result in the desired outcome.   I have said to her to request a face to face meeting to enable both parties to conclude, ideally resolve and at that point we can decide what action we wish to take.

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

Hi everyone,

 

I parked my car at the Peel Centre in Stockport to pickup an item which was reserved for me in Argos.

Its my first visit at the Peel Centre and no doubt will be the last.

 

 

Upon arrival there were no visible signs or parking machines around the perimeter so I gathered the parking was free.

I went to the store to pickup the item but was told it was reserved by their other store just around the corner.

 

 

The staff asked if I parked my car here, I replied yes

and so she advised me to leave the vehicle here and its only a 5 minute walk.

I took her advice but didn't return until an hour later after experiencing a small queue at the store

and receiving a phone call from a friend.

 

 

When I returned back, there was no ticket on my windscreen and so I left the Peel Centre.

12 days later I received a PCN from Excel parking via post demanding payment of £60 within 14 days.

 

I contacted Argos and asked to speak to the store manager

but was told there was nothing could be done which was disappointing.

 

 

Since then, following the advice I received from my friends after the experience they've had from other parking companies,

I continued to ignore all letters and correspondence relating to Excel.

 

 

Currently I'm at the stage in which I received a letter from Wright Hassall solicitors

demanding final payment of £180 within 14 days

or else a CCJ will be imposed upon me which will have impact on future loans and credit rating.

 

I have searched a lot of forums relating to this matter and the majority of the people on here

suggest to keep ignoring them since Wright Hassall has no grounds to issue a CCJ

since their client is ZZPS Ltd who are debt collectors and not Excel Parking.

 

Although it might sound crazy but do I continue to ignore Wright Hassall if this is the case?

 

Any advice would be appreciated.

I bet their letter doesnt say they will impose anything

but threatens you with what might happen if you ignore them.

 

 

Words are important in these matters so read it agin.

As said, they are solicitors acting as debt collectors and rely on their letterhead to put fear into you

and persuade you to pay up.

 

 

Have you asked yourself why the supposed debt has leapt up to £180?

Answer is because they think that if you are going to apy you will apy almost anything that isnt stupidy high

so they ask for jsut under £200 as most people will cough.

 

 

Some debt collectors in the past have asked for up to £700

and when challenged they just hide under a rock.

 

 

the cowboy clampers havent gone away, jsut changed their hats.

 

If you can remember the date of the event or still have the original demand

we may be able to put this to bed fairly quickly.

Finally, I managed to collate all the letters from Excel, ZZPS and Wright Hassall and Yes, you are correct, (sorry) they are threatening me with CCJ if I continue to ignore them.

 

The date of the event was middle of June 2015.

 

The total balance went from £100 which was originally issued by Excel to £150 when the matter was passed onto ZZPS. A second letter from ZZPS demanded this amount to be paid otherwise they will pass onto their solicitors and the total balance would increase by £25.

 

Now, surely the total balance would equate to £175 but no, no, no. When I received the following letter from Wright Hassall, they demanded payment of £180!! So where on earth has the additional £5 come from??? There was no explanation on the letter whatsoever.

Unfortunately I couldn't give you an answer sorry. I was away on holiday until I got back to find a letter from Excel. I presume there is no way of finding out when the letter has arrived at my door?

can you post up the original notice to keeper so we can pick holes in it? There is every liklihood it doesnt comply with the requirements for keeper liability anyway. that would mean you wouldnt have to argue about the content or meaning of the signage that made the contract with the driver.

Hi everyone,

 

Can anyone tell me if they have received an official CCJ Claim form from Northampton County Court?

 

The reason being that I've just received a CCJ Claim form for an alleged unpaid parking ticket dated last year.

 

The form appears to be a photocopy (black & white) but I believe it should be a blue form?

 

The stamp illustrating the crown doesn't appear to be an official stamp but copied.

 

I would like to know whether I've received an official CCJ form and would appreciate if anyone can help.

 

No doubt I will have to treat this matter very seriously in case its genuine and will endeavour to pursue the case.

please get your terminology correct, have you received a N1 claim form or something else? Probably it is that so you have to follow the procedures to acknowledge, deny and defend

Hi,

 

I'm expected to be in court next week to defend my case against Excel Parking/BW legal due to lack of signs at the Peel Centre in Stockport.

 

 

The ticket was issued in June 2015.

 

 

Several months later I came back to gather some photos as evidence only to discover that new signs have been put in place and now designated everywhere unlike before.

 

 

Unfortunately the evidence I have so far would be insufficient to convince the judge and therefore would rely on information from anyone who can provide me details when the signs were renewed.

 

 

I would appreciate if anyone has real photo evidence of the parking facility outside Argos at the Peel centre to illustrate the lack of signs.

Sorry for the late reply... Ive been so busy.

 

I've completed the claim form and submitted my defence to the County Court. I have been offered mediation to resolve the matter but I've decided to take it through court. I will do my best to convince the judge and have some useful information to rely on and hopefully put this matter to rest.

 

so what happened with this supposed court claim then?
