    • Hello and thanks for taking the time out to review my problem.    I was at an ATM I use occasionally. Plugged in PIN and amount, the cash machine whirred opened and closed a few times then said ‘thanks for using’.    I contacted my bank immediately and they have started a dispute. This seems to be a common problem from what I gather reading about this now it’s happened to me.   It seems a bit odd that I have to wait so long to get my money back, if I get it back at all.   Surely they should be able to check the camera and see that there was obviously something wrong and no money dispensed?    is there anything I need to know so I don’t get shafted here by the ATM owner or by the bank dispute?
    • but they didn't remove them 'because' you agreed to pay or continue to pay + i bet they are over 6yrs old anyway and thats why they were removed.     who were 'they' you complained too..
    • they didn't Lloyds did upon or before sale,    anything that they can use to ID its YOU here on CAG, inc AC / ref no's and QR or Barcodes or little numbers down the edges. leave all figures dates etc etc .
    • Trouble is I cant do that though - I absolutely have to be able to get a mortgage at the end of this year and if theres a DMP or "arrange to pay" on it then I cant.   Understand the ones past the default + 6 years cant start reporting but I assume by your answers that the ones that dont have a default date can. This effectively means I will need to carry on paying those 4. I am thinking stop the DMP - make a personal arrangement with the 4 that arent defaulted. At least it will have more than halved the payment - unless there is a way of guaranteeing that they wont re-appear.

      Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
      So I issued the claim on day 15 and they requested more time to respond.
      They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
       
      I opted for mediation, and it played out very similarly to other people's experiences.
       
      In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them. 
       
      In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
       
      In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
       
      To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
       
      So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

TB the advice given here about your credit file is sound. Trust me when I say I know where you are coming from. If we can save you grief we will, we have all been there and done that. This is why CAG helps new posters like yourself.

 

 

If you feel that you don't want to enter your bank details you don't have to. You can do a postal application and that costs about 2 quid, takes much longer but you keep your details from prying eyes...

Hi there dx

 

just had a letter from Studio telling me they are increasing the charges because they have just reviewed my credit account and the risk in me

 

 

they have given me 3 options

 

1 payoff the full and total valence in full

 

2 pay off the existing balance in existing terms with no additional purchases being made closing my account

 

3 pay by direct debit if I choose to pay the account off

no addititional charges will be added

 

they have kicked me off using the catalogue

this comes in effect from the 27th November

they have given me 60 days to reply

 

still no contract agreement sent whatsoever

the new increased interest will be charged from the 27 th of November

 

any thoughts please

 

I'm thinking get in touch with the finanial Ombudsman

 

This is after being a costumer with Studio since 1993

paid like troopers with all the interest

paid this five times over

so no there no kicking us off

but if we chose to stay being a customer

they can now charge us higher interest how crazy

 

Thing is it's a battle with the mrs to stop her buying from them

surely if they paid us all our charges back we could pay the account off

 

 

but if we still was a costumers of Studio and ordered more items

would they still give us the unfairness charges

 

 

when you can't work and you have to buy on the never never

grand kids christmas presents allsorts

that's sometimes the only way you can get things so these catalogues murder you

 

The crazy thing is top of this letter says Notice of variation of a credit agreement made between you and Express gifts Limited trading as Studio church bridge house church actington Lancashire BB5 4ER

 

 

even though I have never ever signed any agreement with Studio what so ever

 

I'm tempted to write back asking for my credit agreement copy and remining them they need to provide this plus credit statements maybe remind them what a good costumer I've been and also make them aware I'll contact the Ombudsman

do I still keep up with studio payments £50 payment due today or tomorrow

 

 

out off the options they have given me best bet is as offered by Studio stop ordering

n pay off my account with no interest added but because of all the charges

 

 

if they give me six years back that would pay off my account plus extra still need more statements from Studio

 

 

they have only sent me 3 years charges for them adds up to around £760

Because the cca to Studio hasn't been cooperative not received a credit agreement from Studio

plus not getting all my statements back from them

Sorry to hear about your stroke it really is an awful experience. First of all the debt is not priority, drop it to a £1-00 pm until you can get you finances in order.

Until they provide an agreement then they cant enforce in court. You don't ask you tell. It is up to you if you inform your creditor of the stroke this may help as I know that dealing with debt after one is a pain in the rear end. If you check your statements you may find that you have unemployment cover have you checked?

you can send a letter of complaint about the missing statements if you wish.

a cca request does not give statement

but an SAR does

not got a lot of debt Micky

a couple of catalogues the mrs was looking after them bless her think there's about £900 on each

 

. Small bank loan as I'm on moterbilty so I have a car paid for by my DLA didn't realise the catalogues was putting so much extras on

Should I still pay my monthly payments ,

 

studio says one option stop the cataloge n pay it off

but with the original interest which paying £50 monthly studio put £34 on in interest so it will still take a while thanks mike

I was ill back in 1993 when we first started the Studio catalogue .

 

 

I am going to close the account no buying anything

but the charges I've paid over 23 years would pay this £950 account off ten times

 

 

if I could get them to agree to write off my Studio account

Nothing more owed

 

 

I don't want all the charges back even though they would be thousands in back charges just begrudge paying more charges

 

is there a template letter for complaint when the CCA has not been complied with thanks Guys

Thought as they did not send a credit agreement signed be me which I know they don't have and only sent me three years statements

if I wrote to them starring that they never sent a credit agreement and only sent some of the statements as the as altogether I've been with Studio since 1/02/92.

 

 

If I ask studio for the three years unlawful charges which come to£936.35 with 8% interest is &1011.25 if they choose not to comply I should let Studio know that

 

 

I've been a good costumer for 23 years but I could always send them a SAR for the 23 years unlawful charges and try to recliaming a full 23 year which would be six times bigger than the £1011.25

 

 

I would be pleased if they could pay it off my Studio account to close my account & paid in full

any extra that is left should be forwarded to myself

 

 

is this a plan that I could try thank for any very grateful thoughts Mike

 

My daughter has just showed myself a email she received a couple of days ago from Studio

all about complaint procedure as she put our first order in to Studio inFeb 1992

 

 

this email is all about sorting the complaint

 

 

studio didn't mentioned this when sending me a warning of excess interest charges

Time to get a SAR off now. This is a tenner and you should get the statements back. Then see how much is charges and reclaim this. Don't for get to add the interest. There are many calculators for this and dx may provide a link to one.

 

 

I think if you push this you may get many of the charges refunded especially those that were at the higher amount like £25.00+ even the £12 ones are reclaimable so get going on this.

I would suggest that as I di again earlier

the charges will wipe the debt out.

 

 

if some silly bugger wants to go to court

it will quickly be quashed.

Hi Micky thanks for the reply all I want mate is this Studio off my head so I thought about just trying to get the 3 years charges which are around £1000 which will close the account threaten them with a Sar for 23 years charges thanks Mikey

Reclaim ALL of the charges, this may take time and will be worth it in the end, we have all been here in one way or another...

Thanks guys balls in my court if 3 charges comes to just over £1000 that's with 8% interest 23 years will 6 time this come to possibly the amount will be to big for them to just let go thanks guys you help has been great if they don't comply it will then have to be the Ombudsman thanks Mike

so I Sar them add up everything then ask for it all to be returned

 

 

if they say. No or nothing strange are studio go the email from them all about sorting complaints but also got the letter telling me they have increased my interest because of this action crazy thanks mate Mike

 

Would I have to pay a charge to the fos for seeing my claim or could it be waved because of my financial standing

I would suspect all the penalty fees [late/over/letter/returned DD etc]

will once int is added at their int rate

outweigh the owing sum.

 

you can send it to Shop Direct

[we have the spreadsheet [CISHEET] here.

 

and see what they want to do.

 

they prob say no

and then sell it to a no powers DCA

then you'll simply sent the sheet to them and say 'wanna try court then...:madgrin:
