• There's a thread somewhere about someone sending the baillifs against Wizzair that is quite hilarious. I would love to see someone do the same to Ryanair. Question is, should you be the one to take that role. You are entitled to the £220, if your flight was from the UK. If it was TO the UK I suppose it is more of a grey area... though the airlines I know have been using £220 as standard. Not that surprising for Ryanair, the worst cheapskates in the universe, to go for the lower amount, and if you forward this to the CEO he will probably have a jolly good laugh and give his accountants a verbal bonus. After all he's the one who said and I paraphrase "F*** our customers, they'll fly with us again anyway". While we would all love to see Ryanair get wooped in court again, I have to join my fellow posters in thinking it's not worth the hassle for (hypothetically) £7 and not sure it will expedite the payment either. It's already an achievement that you got them to accept to pay.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well I thought the problem was that Saudi arabia and Turkey had already sent fighters into Syria (and |Iraq) that was the core cause of the problem.

and that the US initially prevented Assads forces from effectively fighting them.

Also highly interesting that the UK is carrying out the largest invasion style military exercise in many years in Jordan.

Oh, and where the US failed to properly commit to the Kurds (with good reasons in my view but perhaps not good enough) Russia has effectively recognised the Kurdish state and supported the Kurds with effective bombing runs and weapons suppies.

The Kurds are reciprocating and attacking the Turkish supported militants which the west calls civilians/Free Syrian Army who are both Kurd and Assad's enemies, driving them from an air base in Northern Syria.

Those Turkmen refugees on the Turkish border are running from Kurds at least as much as Assad.

Erdogan must be going berserk.

This is Effectively bringing the US nominally supported and Russian acknowledged and supported Kurds into direct conflict with Turkish and Saudi militant groups (aka Free Syrian Army) on the side of the Russian/Assad coalition.

How long before the Russians put air defense systems in the Kurdish held areas to shoot down Turkish planes bombing these Syrian Kurds?

Assad and the Russians need these areas cleared of Turkish militants before a cease fire could realistically be made. They would probably continue to support a Kudish state.

Turkey does not want a cease fire, It wants Syria broken up with the Kurds erased and the North of Syria in Turkeys hands.

The US is in a very difficult position where its allies are its enemies and its enemies are its allies.

What a horrible mess this continues to be, when anyone with sense should have seen there was no good end game in destabilising Syria.

Yes,

There is still a great amount NOT being said by people who should be stating clear facts about the recent hospital strikes. With some reports claiming they were dumb bombs from Russian warplanes and some reports of 'double tap' missile strikes as used by drone strikes, and some that 2 smaller 'planes' flew in from Turkey.

http://www.military.com/daily-news/2016/02/12/us-rejects-russian-charge-a10s-hit-aleppo-hospital.html

I'm not sure which is true, but this looks like another stitch job like the ambush of the Russian plane and the chemical weapons accusations.

The only sense any of these make even in the crazyness of these sort of conflicts is as false flag events.

Its hugely interesting theat if you look at the MSF and red cross sites, their own sites state that their bases are in Damascus, and injured are evacuated to Damascus, and the aid convoys go from Damascus.

Not from Turkey, or from the US coalition areas.

Also interesting that although the supply route from Turkey has only just been cut, the people have been starving for a long time. Obviously not food and medical aide for civilians the Turks were sending along the route while it was open.

It was almost certainly kurds who set off the car bomb against the Turkish military in Ankara.

There was never much doubt that Turkey would end up entering the Syrian conflict more directly, but it quite clear they wanted the US actively supporting them, and they were undoubtedly hoping that it would be as 'peace keepers' after their proxies had toppled Assad rather than as invaders after their proxies failed.

Of course it was Russia, everything that is wrong in this world is because of Russia.

Stop winding him up !

Humans are weapons of mass destruction and have been since they have been on the planet. There can't have been many years, where there has not been a war somewhere in the world.

Pretty pathetic that people can't just get along and live in peace.

And stop exporting weapons to countries which are not fit to have them. ISIS are using American weapons and vehicles stolen from Iraq. Iraq was never left in a stable condition after the second war that toppled Saddam.

But peace is not good for GDP. War, instead, is a catalyst for growth. Kill, kill, kill, if that is good for the economy.

Anyone else think its rather strange that Turkey can get hundreds of Turkmen fighters through the border into Syria without issue when they cant get a small handful of US trained fighters through without the American trained fighters and equipment immediately 'falling' into the hands of al-nusra Turkmen terrorists?

https://en.wikipedia.org/wiki/Syrian_Train_and_Equip_Program

"Seventy five Syrian rebels trained by the United States and its allies to fight Islamic State have entered northern Syria since Friday, the Syrian Observatory for Human Rights said on Sunday, 20 September 2015. Reuters reported that Rami Abdulrahman, director of the Observatory, said the rebels had crossed into Syria from Turkey with 12 vehicles equipped with machine guns.

Soon afterwards however, there were reports that the group handed over their brand-new trucks, weapons and ammunition to the al Nusra Front, almost immediately after crossing the border back into Syria."

and on a more positive note. The Russian and French airstrikes have hit ISIL hard - where it hurts

and Saudi Arabia confirms sending Jets to Turkey

http://english.alarabiya.net/en/News/middle-east/2016/02/14/Saudi-Arabia-confirms-sending-jets-to-Turkey-.html

Why is this significant?

1. Turkey and Saudi arabia are the real instigators of the conflict in Syria and both have ground fighters in Syria (some of the 'foreigners the syrian fighters refer to) who are being pounded by the Russians

2. The US withdrew its fighters and missile defense systems from Turkey after they shot down the Russian Jet. Saudi Arabia has more later model Typhoons and brimstones than the RAF has.

3. Both Turkey and Saudi Arabia are pressing for ground invasions into Syria to support their 'proxy; forces there.

4. Saudi Arabia is NOT a member of NATO, or even a MNNA, and has already had non-compulsory arms sanctions imposed by the EU. (Russia MAY feel free to shoot these out of the sky WHEN they attack the kurds and Assads forces in support of the Turkish and Saudi proxy forces - many of which are associated with ISIS)
