debt on credit file, wrong info

Hi,

Im wondering if anyone out there can give me some advice on my problem.

 

I have been advised by step chance to apply for a DRO due to a very high debt that i just cant afford to pay off,

 

upon searching my credit file I came across a debt from NEXT stating i owe £89

 

now it was my name and address but a different date of birth?

I dont ever recall opening a account with next so I was totally baffled,

 

i called step change and they advised I call next to try to get some info as to what its all about.

 

When I called them they claimed the account was set up at the time i moved into my property and orders were placed,

the account is in my name but a totally different date of birth.

 

I explained i did not set up this account and they were questioning who was living in the property who had access to my details ect,

 

the only people that could have was my ex boyfriend and my child minder neither i speak to anymore.

 

Ive had no correspondence what so ever from next regarding this,

they claimed i must have got statements but in all honesty i cant really remember getting anything,

 

I have had so many debts building up for years ago,

i get all sorts of letters that i have ignored in the past :(

 

Am i liable for this debt?

I need to get it off my credit report before i can apply for the DRO.

 

They have said they have set up a investigation but i could take some time,

 

ive stressed the urgency of it all they said was they would be in touch.

 

Any advice on where i stand with this?

You will need to write to the Credit reference agencies that are carrying this information and tell them it is incorrect and that you are currently in communication with Next. They should be able to put a Notice of correction on the file for you.

 

You should then write to Next at their Head/Registered office and tell them that you have no knowledge of this debt and that unless they can provide absolute proof that it is you who entered into this agreement, you would like it removed. You will need to head your letter Formal Complaint. Sadly, it will take up to 8 weeks for this to be resolved.

I was going to suggest sending a Subject Access Request to Next would get you all the info on the account regarding payments made ect letting you know how and when any payments were made ect.

 

But that's a £10 you should not have to spend.

 

Ask Next to send you proof of this account eg: copy statements ect.

Why is this debt preventing you from applying for the DRO - from next month the limit of debt will be £20,000.

yes ill get in contact to ask, i wonder if i could email them. I get terrible anxiety on the telephone and i was spoken to like a criminal yesterday i nearly had a panic attack! cant believe this is happening i was so relived when they recommended i get a dro it felt like a weight had been lifted but it back again :(

Ah righto, I see the problem now.

 

In the first instance, contact the credit reference agencies and explain this. Perhaps get a notice of correction placed and see what that does.

I hope you have checked via a CCA request the each of your debts are enforceable?

And you've got all the statements of each debt and that there are no penalty charges and PPI to reclaim?

 

As for the next debt

I'd be contacting action fraud

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
