Bailiffs demand reverse checks from DVLA

Bailiffs are calling on the DVLA to allow reverse checks on the registered keepers of vehicles, where a judgement, order or fine has been imposed.

 

Enforcement firm The Sheriffs Office has made the request after seeing what it called a “blatant attempt” by some drivers to prevent enforcement of legitimate sums owed to individuals, businesses and government.

 

The Sheriffs Office claimed that consumer forums are advising debtors to move their vehicles away from their property, so that enforcement agents cannot tell which vehicle, if any, belongs to the debtor.

 

The firm said this behaviour means the recovery of judgments, orders and fines is becoming increasingly difficult.

Problem is as highlighted in the article DVLA V5 record of Keeeper doesn't prove ownership, so more money for the courts when the Sheriffs, and the creditor force interpleader. Their assumption that majority keepers are owners isn't strictly true at least with newer vehicles.

 

More likely with a £500 1999 Focus though, and that sort of banger worth under a grand it isn't worth bothering with apart from clamping it to coerce the debtor, even if it means debtor cannot get to work at unsocial hours where no buses etc and earn money to pay off the debt.

Even though i agree there has to be some sort of punitive penalty for those people who deliberatly try and evade their responsibilities.

 

The fees these baliff companies charge are way above what is acceptable and reasonable. There reputation as being the evil Prince John or the Sheriff of Nottingham is well deserved, as well as their own dubious practice when it comes to legislation and dealing with vulnerable people.

 

It is a bit rich them now crying foul

 

Baliff enforcement as it stands at the moment needs to be repealed. It is unecessary in ths day and age with attachment of earnings and benefits. It is about time the Government of any political party started to grow up and start living in the 21st century

Lord Denning tried and failed to get it abolished last century, too much money and jobs in enforcement at stake

I am not at all in favour of allowing DVLA to provide such information to enforcement agents and I would question whether they even have the facility to enable such a search to be conducted.

 

I also disagree that debtors are hiding vehicles away (and in particular are parking vehicles on a neighbours driveway to defeat seizure of the car). Can you imagine the scene. I receive a Notice of Enforcement and then call my friendly neighbour to ask him whether he minds if I park my car on his driveway for a week or so. He asks me why. I would have difficulty trying to say that my driveway is being repaired so I tell him the truth that I am expecting a visit from a bailiff. You can just imagine the response from the neighbour.......NO.

Have to agree, it would bea disaster at least to let bailiffs have that facility, DVLA would grind to a standstill under the requests for information, they are noted for not even keeping their own data correct with many spurious fines for non crimes themselves.
