    • Aesmith - Thank you for your recent interest in my issues.  Input on people's topics can be most useful from specialised experts or those that have similar experiences.  Some people really struggle with knowing what to do (I certainly do) - so it is most useful and helpful and reassuring when solid sensible advice is offered.  I have found there to be some very kind, helpful, supportive and legally knowledgeable people here on cag over the years - who give sound legal advice for people to roll up their sleeves and follow up on.   Of course, sometimes it can be quite challenging sifting the wheat from the chaff.  I don't have lawyer or barrister.  I sometimes attend pro-bono legal clinics for help.  And sometimes have access to barristers via a pro-bono service called Advocate.  Both ad-hoc. Pro-bono means 'free'

    • Ok you are in the clear. The PCN does not comply with the Protection of Freedoms Act 2012 Schedule 4 for two reasons. The first is that in Section 9 [2][e]  says the PCN must "state that the creditor does not know both the name of the driver and a current address for service for the driver and invite the keeper— (i)to pay the unpaid parking charges ". It does not say that even though it continues correctly with blurb about the driver. The other fault is that there is no parking period mentioned. Their ANPR cameras do show your arrival and departure times but as that at the very least includes driving from the entrance to the parking space then later leaving the parking space and driving to the exit. It also doesn't allow for finding a parking spot: manoeuvering into it avoiding parking on the lines: possibly having to stop to allow pedestrians/other cars to pass in front of you; returning the trolley after finishing shopping; loading children disabled people in and out of the car, etc etc.  All of that could easily add five, ten or even 15 minutes to your time which the ANPR cameras cannot take into account. So even if it was only two hours free time you could  still have been within the  time since there is a MINIMUM of 15 minutes Grace period when you leave the car park. However as they cannot even manage to get their PCN to comply with the Act you as keeper cannot be pursued. Only the driver is now liable and they do not know who was driving as you have not appealed and perhaps unwittingly given away who was driving. So you do not owe them a penny. No need to appeal. Let them waste their money pursuing you .

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sent a claim for PPI on EGG credit card : had paperwork as I had sent a SAR request. Statute barred debt £6k.

 

Reasons given are several and it's their final response. Application was March 2002. They say the CRP policy box was not pre-ticked (online application) They say I was fully informed and it was my decision to take it and it was up to me to decide if suitable for my needs? and that the policy document would have been supplied to me which would have explained everything

 

many thanks the letter was dated 14th September : received 17th September

 

Is it worth sending to FOS.

Can't do any harm for the price of the postage. Did you need the ppi, did they advise you could get it elsewhere, were they ask about prior medical conditions. It won't cost you anything but it'll cost them for fos to look at it.

I put all of those reasons in my claim but they just say I had the chance to check for myself etc etc etc.... I will send it . Is there a questionnaire or covering letter many thanks

checked paperwork from SAR and I can't find copy of the online application..... I can't recall if the box was pre - ticked (they say it wasn't) but they haven't sent any evidence to show it was/wasn't. Does anyone know if in March 2002 the PPI box was pre-ticked please?

This is standard Canada Square (Egg) tactics. It is worth going to FOS. I had exactly the same problem, it took 3 years but eventually the FOS supported my claim and made them pay up. Mind you, Canada Square fought, squirmed and wriggled every step of the way. But lots of satisfaction when an Ombudsman forced them to pay.

 

 

Go for it.

As indicated on this thread I sent my complaint to the FOS :

FOS letter received yesterday and they have ruled in my favour!!

 

 

The letter says I will be getting an offer from Canada Square Operations that will put me in the position I would be in if I hadn't taken out the policy

and that I should not have been sold the PPI.Hasn't taken long at all

 

I nearly never bothered but as always CAG is my first port of call.

 

 

Let's see what happens : FOS say allow 8 weeks for calculations and then contact Canada Square Operations if I don't hear anything.

 

 

It's a substantial amount : incidentally just had a letter from PRA group acknoweding original debt is Statute Barred.

 

 

Original debt was sold on with NOA.so they shouldn't try and offset...

Thanks for the update Cleo. That's great news.

 

You inspired me to have a crack at claiming from YB too. I tried to get info in 2006/7 but couldn't get info from them but they hadn't been fined then so I'm hoping they'll try harder now. I've got some info but not everything so if push comes to shove I'll give them the limited info I have. They're well past the time they should have responded but say they'll be in touch by 29th Feb. We'll see.

I didn't have all the info either but neither did YB :

hence them going back to the beginning for calculations.

It was life changing money for me.

 

 

This is what I love and respect about CAG :

to encourage others and help if you can.

 

 

I can honestly say it's helped me to change the way I think about it all and not panic.

The EGG was the last of everything for me but I want to still contribute to CAG

tried to call Canada Square Operations yesterday :

I know it will be more than eight weeks before they contact me ,

just wanted to confirm everything...

 

 

well I spoke to a "Supersnotty" young lady who wouldn't take my name or reference number,

refused to speak further and just referred me back to my FOS adjudicator.

 

 

She said even after eight weeks passes she still won't speak with me

and would refer me back to the FOS (however the FOS in their letter say if I don't get anything after eight weeks to contact Canada Square directly!! )

 

 

Definitely last in the courtesy/manners queue.

 

 

I reported her to the FOS (who I have to say have been very courteous and helpful)

they rang Canada Square on my behalf and confirmed that they are dealing with my case

and will be sending an offer in due course.

Why should it take another 8 weeks? Haven't the calcs been done?

apparently not : in the FOS letter they say to allow 8 weeks for the calculations : its only been 3 weeks so lets see. The important thing is I never nearly bothered but like you say for the price of a stamp...... If I don't hear anything by the end of the 8 weeks I'm getting straight back to the FOS kind regards

letter received today

 

 

: Full and final settlement offered of £4300.

 

 

This ties in well with the amount claimed .

 

 

Will receive a cheque within 30 working days!!!!!!

I nearly never bothered to go to FOS after receiving Canada Square's final response.

 

 

The FOS have been a great help and as always this site.

spoke to FOS today : they rang Canada Square whilst I was on hold. Advised should have the offer by the end of the week, if it doesn't materialise FOS said to ring them back middle of next week......
