      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

A disabled teenager killed himself on the same day that pay-day loans company Wonga cleared out his bank account, leaving him without a single penny to survive on.

 

Kane Sparham-Price, who had “numerous problems including those connected with his mental health”, had spent much of his life in foster care and care homes, and took out loans through Wonga’s website after he turned 18.

 

But thanks to a legal agreement he had signed with Wonga, the company was able to take part-payment of his debt from his bank account, leaving it completely empty.

 

And because part of his debt was still outstanding, he could not borrow any more money.

 

Later that day – believed to be in 2013 – he was found dead at his home in Manchester.

The coroner was so alarmed that..

 

 

A coroner later concluded that Sparham-Price had killed himself, and was so alarmed at Wonga’s behaviour that he wrote what is known as a regulation 28 report and sent it to the Financial Conduct Authority (FCA).

 

 

His report was sent to the FCA 12 months ago, but its existence was only uncovered by Disability News Service this week.

I was watching something I had recorded ages ago the other day and saw one of the Wonga adverts with the puppets - made me realise how far the 'industry' stooped to promote its 'products' of destruction.

 

The use of CPAs should be severely restricted TO THE ORIGINAL LOAN AMOUNT ONLY and no other charges. There is also good cause to leave at least £10 in the bank account but of course the 'debt industry' sees everyone in debt in the same light that IDS sees ill, vulnerable people.

But Wonga do make hefty party political donations

 

How making interest rates up to 6000% can be legal and allowed to continue is beyond me. It was for this reason these ******s were literally banned in the USA.

 

Not to mention these loans totally screw your credit rating.

 

They are a canker on our society and need eradicating

A very sad story.I am lost for words really.I will leave that to others this time,i am finding it difficult to say much at all.Thinking about things.

 

However what i will say after reading the posts is many vulnerable people with Mental health problems seem to have problems with many things,even housing issues.

As i found out some time ago here in the forums.

And i was talking to someone who worked locally for people with mental health problems and both the staff and patients worrying about cutbacks and how it would affect them.

So many people living alone and reliant on the help these caring staff can bring to them.Many it seems their only contact with anyone.And enjoy it so much.

 

As for the donations to the political parties and politicians by payday lenders well that is still going on as we speak in America anyway,i have not looked to closely here lately.

 

The thoughts of Damage by having payday loans whether paid back early or on time,perhaps thinking they help your credit file has been covered here.A absolute nightmare for many costing many things,even mortgages turned down.Car loan things like that

Kind of Young couple excited,young go into the mortgage advisers office say "Hi we are here to get a mortgage we are both working and are so excited to be buying our own home.

Adviser says,"Hold on a moment youngsters you have taken a payday loan out a while ago".

Couple say "Yes we did we were told it would improve our credit rating which was great anyway We paid it back early."

"Oh no youngsters this is not so,would you kindly shut the door on your way out.

Same with car loan.Go away you are not worthy.

Clip clop off you trot. Shanks's pony for you young people.Be gone before i send for the gatekeeper.

I understand Sillygirl1 what you are saying about IDS and find it hard to comment once again.

 

Anyway i will leave you now to think about the young man and his family and maybe comment on this as you feel fit.

A sad story and hard to read or listen to for many.

The harm these loans have caused to many people and communities is yet to come to the surface i feel.

I think you may be referring to Adrian Beecroft.

Now do not look to closely at him and what he does and has done without wearing some sort of protection.

You will be blinded.

As you say a advisor to the Conservatives whose report they said being so extreme on workers rights would be buried in the cellar.

All have risen from the cellar and are in full working order now.

And massive donor, and investor in Wonga at one time.

How do they sleep at night.

 

Who is pulling our strings or governments strings thoughts from orbiter dictum.

I have often thought that myself.

Ended up thinking globally.

Myself finally came to think somewhere in the world there are really powerful ones we do not know about.

A group of super beings who sit down and control the economies and people and governments of the world by juggling us a you say like puppets.Massive huge unbelievable,unimaginable resources.

Deep thoughts i suppose for this time of day.And most likely completely wrong.Who knows what is going on out there.

 

A game with so much at stake down the line for the people.

And whose actions can lead as we have seen to tragedy for many.

How many people getting sanctioned have lost their lives i wonder.

How many vulnerable sick people have lost lives through IDS and his greedy powerful friends.

Adrian and Ian could be twins.

 

How many people through Payday Loans and CPAs have lost theirs when their accounts are emptied with the biggest gold plated money extracting hoovers in the world.Around the world how many.No food,nothing left.

Sucked everything out and left nothing but dust.Dust that is all they leave.Nothing but dust.

Charges, fees,rip off interest rates taking everything you have.

Why is it the poorest in society pay the most for everything.

Time to sort things out.Time for action.

 

And has led to this young mans death.So tragically.

Myself and many others i feel are finding it hard to say what we are feeling about this tragic event for a family.

But i hope many will try.

One more thing. CPAs when in trouble.Find yourself unable through any number of reasons to pay.

“The payer may withdraw its consent to a payment transaction at any time before the point at which the payment order can no longer be revoked under regulation 67.”

 

Please confirm in writing that this instruction has been received and actioned.

Among Beecroft's known personal investments are Gnodal, a computer networking company, and Wonga a high interest loan company.

Beecroft has donated more than £500,000 to the Conservative Party since 2006.

 

 

The release on Monday 21 May 2012, of the long awaited "Beecroft Report" in the UK caused considerable controversy because it recommended that the government should cut red tape in order to make the hiring and firing of employees easier. The report claimed this would help to boost the economy although no evidence for this was provided.

 

It was alleged that significant sections of the report had been doctored. It was also reported that some recommendations had been removed from the original draft of the report. On 21 May Secretary of State for Business Vince Cable condemned the report, saying it was unnecessary for the government to scare workers.

 

Beecroft responded by accusing Cable of being a socialist who does little to help business and cited his own personal experience of having to pay out £150,000 for unfairly dismissing an HR employee as one of the reasons he included the idea in the report. One newspaper connected the recommendation to Beecroft's career of cutting jobs.
