Anyone come across this lot?

 

Received a very aggressive email from them chasing a really old debt of £127 which they say was attributable to EPDL, and going straight for court action...

 

Emailed them to say don't remember this and who are they and was emailed back with:

Ecashwindow Ltd is the new name for Early Pay Day Loans and are happy to supply you additional information you require.

 

Call 01908 440050 in order to discuss further.

 

In the meantime legal action will continue.

Although to also add, I see threads about them and their business practices :)

I wouldnt want to second guess them though... Might be worth getting the information from them in writing?

EPDL are a trading name of ecashwindow and have been since inception. They are just trying to confuse the issue.

 

You can continue to email if you wish and if so, try this guy:

As they are implying that they are continuing with legal action, ask them for proof that this action IS going on and not a bluff (as is usual with these companies)

 

As you don't remember this debt, demand they put up or shut up. You want absolute proof that you applied for this loan and the bank account the loan it was paid into.

 

If (as I suspect) they are trying it on, make sure you contact trading standards as threatening court when they have no intention of doing so, is threatening and harassing.

 

Keep all emails safe.

ecashwindow are one of the companies I got my interest refunded from due to them not undertaking affordability checks prior to the loan ( it was Early Payday back then). If the debt is yours, I'd hit them with a letter around irresponsible lending asking them to prove the affordability checks they completed (which will be none) and that you will escalate complaint to FOS (will cost them around £550)

Hi,

 

Well, I emailed back and basically said - "I have no idea what this is for, send me all the info via email ( I refused to call, as they kept asking, as i would have nothing in writing), ALONG WITH the affordability checks they should have carried out and... surprise surprise, I've heard nothing...

 

I think they are shysters who keep no proper records and would use bully-boy tactics over the phone of you actually called them to get money out of you...

hi, have you any updates to share...thought you may like to know they have written my debt off...i just kept on at the buggers, raised a complaint with them and the FOS and told them i'd take court action against them....for now it appears to have worked

Hey Acid. I am trying to complain to them also about my charges. everything was paid in full but I had loans/extensions with them for nearly 3 years.

 

I finally got a reply from the contact posted on here. last week. How long did the process take you?

At the moment they are still looking at my complaint.

 

I did send it at the beginning of October a few times via email but received no reply whatsoever. I even tried using their online inquiry form but didn't. But tried the contact above and he emailed me back almost instantly to say they are looking at it this week.

 

I am eager to see their reply.

took a loan in June 2011, then extension after extension.

After multiple extensions they would say you can not extend anymore but can pay an amount each month to clear part of the balance and a £50 extension fee.

once the balance was cleared they gave me a new loan and the same thing happened over and over. From June 2011 to January 2013.

The extensions were all by email and very simply. Please let us know if you want to repay or extend. Nothing else was mentioned.

all good then - long term pattern of lending with multiple extensions and no evidence of checks almost always gets upheld by FOS so think you have a great case. with the FOS you can get the odd curveball thrown at you by certain adjudicators but cannot see how you would lose this based on what you have said. Assume your credit record was pretty poor as well?

 

i would definetely stick to your guns with FOS - remember it costs the company over £500 for each case as well so bit of a double whammy for them. Nearly all payday lenders I had complaints with insisted they had done nothing wrong so it is all part of the negotiation

I will let you know how it goes. I am still eagerly waiting for the reply. The said they would be looking at my complaint last week.

 

And another 2 companies I am also waiting for a reply have the 8 week deadline coming soon.

 

I really hope for a resolution on all of them but will take it further if required.

Further to advice from this post, I received this back (after at least 2 months!!)

 

Dear Mr XXXX

 

Further to my earlier emails today, 01/12/2015 please note the following.

Your income and employment was checked at ‘Employer on System’. A full credit check and debt analysis was carried out with Experian and Teletrack. Affordability was therefore checked to the correct and appropriate standard.

remember it costs the compay a case fee of over £500 for each case lodged with FOS (once they pass their free threshold of 25 which I am sure they will have done). I dont believe a small outfit like ECashwindow will fancy paying this so there may be an opportunity to do a deal with them before going to FOS

I'm going to have to pull them up with the threat of FOS then because this is the email they repeatedly send:

 

As you have failed to repay your loan, we are preparing a DEFAULT NOTICE which will be followed by a COUNTY COURT JUDGEMENT at your home address.

TO AVOID THIS CALL 01908 440051 OR SMS to 07860 027808 and we will confirm your balance and the ways to pay.

When we issue a County Court Summons at Northampton County Court for recovery, in all cases we apply for a Warrant of Execution to be issued and effected through a Bailiffs visit.

If you have paid this within the last few days, or contend that the loan is not due and can prove this, please contact us as a matter of urgency

Ecashwindow is the new name for Early Payday Loans. We are the same company, but have a new name.
