Good Afternoon

 

Hopefully I have posted this in the correct place

 

I recently return from a job abroad

 

 

since getting a new place started receiving mail from Cabot re an supposed out standing balance which they have bought (under 500)

 

today I returned home to a letter from Mortimer Clarke telling me their client (cabot) has instructed them to start legal proceedings which would lead to a ccj

 

they have recently added to my credit file a default

but it also states this was default in 2011,

 

 

some one has advised me to send a cca request but i am not familiar with this

and whilst there is so much great information on this site,

it has me a little info-dizzy.

 

 

so I was hoping someone can assist

who was the original creditor?

what was the debt, credit card ,loan, overdraft etc?

when was the original ac started?

PLEASE HELP US TO KEEP THIS SITE RUNNING

I will send the letter today just one qustion on the 2nd paragraph

 

I expect you to comply fully and properly with this request, within the statutory time limit. You are reminded that should you fail to comply with my request; the provisions of s.77(4)a/78(6)a/79(3)a(delete as appropriate) will apply.

 

it states deletes as appropriate would this be S78 or Sa78 ?

The original creditor Vanquis

it was credit card

oricignal ac started 11.12.2010

cca request under s78 so s78(6)

 

be aware that a recon would be acceptable, due to acc starting post 6/4/2007

and read the full cca request thread first...

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

This may be full of charges and insurance (ROP) when you took the card out did you ask for ROP? If not get reclaiming it and don't forget the over limit fees and late payments. As it could wipe out your debt. Have you got all of the statements?
