    • Hi   My son lives with me and he is on the electoral roll. My ex moved out 2 years ago and I doubt if she is still on the roll.  The account is in my name only and the other email addresses have never been supplied to Octopus. The account is in my name only and I cannot see how they got the other email addresses.  I would prefer to keep any correspondence with Octopus in writing so that there is a clear record of any discussion, but if I reply to the mail, do I just pose these questions and ask where they got the info (have they hacked me) and why have they copied in other people who are not on the account or is there a set form I need to use?
    • Hi welcome to CAG, just a couple of questions so the Team can get a bit more background and explore options with you.   Are those other people  copied on the Register of Electors at and are living at your address?   Is the bill solely in your name only?   Bit naughty if they have involved third parties, and that would be breach of GDPR, same as if a bailiff knocked and gave full details of a third party debt to you.   Might be worth contacting the ICO and asking them, I would ask Octopus what they are doing, if by phone record the call.  You could tell them that you consider it a GDPR breach and you will be reporting them. to ICO.
    • Ok, just cancel the DD mandate via your bank.   The gym or their admin Co will complain and tell you you owe increasing amounts of money but come here first before making any response.   There are no consequences you should worry about. Empty threats !!   Read other threads here about Harlands and their methods pre-lockdown.  
    • Who would I address the letter to?   The website says "Canalside Motors' as does the invoice. I have just checked and there is a Limited Company operating from the premises called 'Perry Barr Motors'. I do not have the individuals name.   I've seen this on those bailiff shows where they will try and wiggle their way out of paying by using different operating names.   Thanks. 
    • Good morning, I hope someone can give me a little bit of advice on an issue please? I have received an email from Octopus Energy advising that I have a debt and that it has been referred to Churchill Recovery Solutions.  Fair enough, I am in arrears.  However, there are issues about the email that concern me. They have copied my ex-wife into the email and also sent a copy to my son. My son's email address does not appear on the other recipients so I can only assume that he has been copied in under Bcc. So the concern here is, where did they get these email addresses from? I never supplied them so have I been hacked? Secondly, have they breached GDPR laws by copying other people not named on the account into sensitive and confidential information? The claimed balance outstanding was clearly displayed on the email.   I am a little unsure of what steps to take here and would appreciate any advice/opinions please.   Many thanks in advance.

    • Hi,  
      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

I remember them cancelling one policy when I took out a new loan and they applied the rule of 78 as a cancellation fee as they were apparently losing interest on it due to the cancellation. I now know it could have been used instead of starting a new one.

 

Don't know if they rolled one over or not. Hope so!! ;)

well how the heck can you check they are correct without them.

 

 

I've done 7 people on yb loans and they all got statements

one lot went back to 1982! 7 loan chain.

his first offer they made was £3k

 

 

ended up at over £19k .

 

 

do not trust them an inch

Don't worry. I have experience of them and don't trust them an inch.

 

Did they get statements of the loans? I'll def be pushing for full info.

thats one of the q's on one of those bank ppi forms. ie where a loan, with ppi, is consolidated and the ppi has just been rolled onto the new loan ie missell.

I don't think it was as I remember it being cancelled and the rule of 78 cancellation being explained. But if there were more loans than I remember .....

They have included 8% simple interest but I think I paid 10 or 11% and will question it and ask for more detail. I was also OD a lot at the time and the interest rate on that was high I think. The acceptance letter makes it clear if I accept it's F&F.

 

I'll have a think over the next few days a about whether to accept it or push for more detail and hold out for more. Who knows how long that would take.

 

 

The simple interest is what your money might have earned you, if you hadn't used it to pay PPI (this is totally different to the interest that you paid), they should give you a full breakdown of how their calculation was worked out and they should also refund the interest that you paid on the PPI at the prevailing rate at the time of the loan.

 

The calculation should be something like this:

 

Premiums Paid:

+ Compound interest: (that you paid on the premium)

+ Simple Interest:

+ Late Fees (that you may have been charged):

- Less Tax on the Simple Interest (currently 20%): (if you are a non taxpayer you can look to claim this back from HMRC)

= Total due to you:

What they are offering is premiums paid and 8% simple interest less 20% tax on the interest. They are saying I agreed to charges under t&c's. No mention of compound interest.

 

I am now thinking that the early redemption may have gone into a consolidated loan but need the paperwork to be sure. I'll certainly say I believe that happened.

 

The more I think about it the more I'm determined to fight for every penny.

Just double checking before I respond. My letter says:-

 

I note that there is a record of the accounts being in arrears. I can confirm that all charges and interest applied to your account were done so under the t&c's that govern the account as agreed with you on completion of the application. I therefore regret that I am unable to uphold your complaint.

 

It goes on later to say:-

 

The compensation is intended to put you in the position that you would have been in had ppi not been applied to your loan accounts.

 

I would say that had I not been paying ppi I wouldn't have had the charges so to put me back in that position they should be refunded with interest.

 

Also the bank charges Supreme Court judgment only applied to current accounts so loan charges should still be claimable.

 

That's right isn't it?

If you can prove that the additional PPI charges were the cause of the fees, then you should be able to get them refunded and your credit file amended

This was all years ago so well off my credit file but being forced to pay for this would clearly have been a contributory factor. Hopefully the additional info I intend to ask for will help prove it.

It seems that the department dealing with ppi don't have the information to show how they made their calculations. How bizarre!!

 

SAR sent, although had they sent everything in 2006 when I sent a sar before I wouldn't need to do it now!!

Oh for goodness sake!! They want me to go into a branch with ID because the info on my sar isn't sufficient for them to send me anything!!

 

Strange that the ppi team were able to denal (after a fashion) with my refund!! I haven't moved since my account was closed and my name's the same so I really don't get their problem.

 

I'll do as asked but only because it's not worth the hassle and delay, so no big deal going into the branch. Just ludicrous!!
