      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Howdy!

 

Entering a Token Payment Plan with StepChange as been avoiding creditors for long years now.

Could someone tell me how to find old bank account numbers, old ref numbers to finish off my paperwork for TPP?

 

I haven't kept any old letters etc, and I'd like to avoid ringing creditors at all costs.

My credit report doesn't exactly show ref numbers.

 

Is it actually crucial to find them anyway?

Sending a Subject Access Request should get you account numbers ect.

One for each creditor, but list all accounts held with each individual creditor it's one fee for all accounts with one creditor.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

But most of my debts have been passed onto DCAs, some debts several times. I have more than 10 creditors and each SAR is £10, if I'm correct?

 

Just about to enter token plan with StepChange however I've got a feeling that I may have had some PPI and not overall sure about some debts.

And from what I've read StepChange will not check for things like that, just settle with DBAs on the amounts they give.

Maybe asking the DCA'S to prove you owe these debts would enable you to work out whats what, you say you've been avoiding these debts for "long years now" how long, are any of them statute barred ect ?

I honestly got lost like hell :(

 

Thought I gave StepChange all my creditors (I only got access to noddle credit file)

but then double checked and some entries were doubled on my crf and the more I look into it the more lost I get :(

 

I just want to be sure that before I commit to paying my debts I will be paying right amounts to right people.

 

All of my debts are after 2007 so I don't think they're statute barred.

I am willing to do the right thing and tackle my debts

but I don't want to play cash cow game with creditors/DCAs.

 

Would it help if I listed my debts here and maybe someone could advise me how to approach and who to approach for ref numbers and amounts?

This will be a long post as I completely do not understand my credit reports. I obtained two of them - checkmyfile from 05.09.2013 and noddle from 29.09.2013.

Therefore I will list all creditors as they are in those two reports. Some entries may be doubled but I'm just putting stuff as it goes (btw are doubled entries normal or should I try and get them sorted out somehow??)

Sure that I had credit and a store card with PPI, how to get round reclaiming it?

Natwest and Lloyds were both destroying me for years with their bank charges, snowball effect, borrowing more and more, now in hardship and on ESA due to depression, anxieties, insomnia, suicidal... Would it still be possible to reclaim bank charges?

 

Considering to enter StepChange token payment plan but from what I've heard they would not check properly legality of debts nor proper amounts :(

 

Not sure what to do, any help would be greatly appreciated!

Hello natek, now that is one hell of a credit file!!

 

I agree SAR to NatWest and Lloyds to start with Lloyds is a large amount.

 

Motor Mile is most certainly a PDL as this company reports PDLs as mail order for some reason, could be challenged on this if have not had a mail order accounts.

 

SAR costs £10 statutory fee, there is a template in the CAG library for this they have 40 days to comply, so do these first.

 

I will help with draft letters to MMF on the ''mail order' accounts if you wish.

I would like to SAR Natwest and Lloyds on Wednesday. Problem is I don't have ref/account numbers.

Should I just send them SAR with the date the accounts were open (from my credit file), address of the branch I opened the accounts with, together with my address at the time of opening + all later linked addresses?

Will that do?

 

+ I would like to tackle Capital One and Topman 7 Store Card for PPI which I am sure I had.

 

And which of the others should I greet with warm CCA request?

May I suggest taking the accounts just a couple at a time otherwise this could get very confusing.

 

Make up file for each debt with all the letters etc., that you have and names of DCAs if they are involved.

Okay, following your advice - natwest and lloyds SAR will be the first thing on the agenda on Wed morning :)

I just thought that since SARs take up to 40 days I could do something productive in that time.

As you mentioned in a previous post, give them the date the accounts were opened together with your address at the time and any more info you think will enable them to find any accounts.

you need to get those CCA's off

esp to the DCA's on all the credit cards.

 

as for all the mobile debts.

 

you have one hell of a lot of mobile accounts?

did you enter into all the contracts?

Mobile phones... Yeah all mine. Was behind with bills so they cut me off. So I stupidly went and got another contract. And so on...

 

Okay, will send cca to all dcas above. Also will sar lloyds and natwest. Going to write them now and off I go to the post office.

 

Problem is when I cca all dcas they Will have my current address :( not keen on that but hey, needs must I suppose...

As I cannot provide you with reference/account number I listed my previous addresses to allow you to identity me.

Or should I attach a scan of my drivers licence so they can identify me? I mean I went through maaaaany threads on CAG and I don't want them to reject any SAR/CCA due to change of the address.

I've read that CCA and SAR should not be signed.

So should I just:

a) type my name in word editor and print it all together or

b) use CAG anti-tampering thingy?

 

Sorry guys to be relying so heavily on you. I'm doing my best to read relevant threads and learn as much as I possibly can!

It's just my first time standing up to those companies and I just don't want to cock it up :noidea:

Okay, fired off CCA's to MEM Finance, Motormile and Wescot. Also sent N245 and EX160 to Northampton County Court.

 

Haven't got moneys for now to send off SARs to natwest and lloyds.

Also requested statutory credit report from experian and equifax.

 

That's me done for today, I'll keep you posted.

Just had a CCA request (dated 09.10.2013) returned from Wescot together with the postal order :/

 

They are saying that I need to confirm my DOB and last known address, in order for them to prevent the breach of the Data Protection Act.

 

Weird, as they were previously sending me letters to my current address. And all of the sudden they are not sure that I am Me? I mean...really?

What do I do now?

I have received great help from CAG on several occasions and contribiuted a bit. Did you? :ban::boink::madgrin:

Dear Wescot.

Ref: Your letter dated xx.xx.xx in regard to my request made under sections 77/78 of the Consumer Credit Act 1974 (as amended).

 

Your request for further data has been noted, but as Wescot have been corresponding with me regarding this alleged debt and in doing so has disclosed data relating to this matter, it would now appear that Wescot have been contacting me when it was not sure that it had contacted the right person, a clear breach of the OFT Guidance on Debt Collection.

 

Therefore I am returning the £1 postal order and require Wescot to comply with my lawful request within the remaining time of the 12 + 2 working days allowed by the act.

 

Failure to do so will place this alleged debt formally in dispute.

 

Send by recorded/signed for post, address to the data controller.

Hello CAGgers :)

 

Checked my credit report today. I have a few questions regarding some of my debts.

 

1. Most of my default dates will reach 6 year period at the end of this year/beginning of next.

Does that mean that after 6 years from the original default date those debts will be out of my credit file?

Does that mean that my credit rating will start improving?

 

2. I sat tight and made no payments for a very long period of time,

not have made payments since default dates anyway so will that mean that my debts get statute barred?

They are credit card and loan debts etc.

 

3. I very briefly entered IVA in 2011 and made 2 payments there

- but none of my creditors recorded those payments on my credit file!

 

 

I remember something about that IVA that I had to pay some money up front for setting it up,

could it be the case that those two payments went just for that

and my creditors didn't get any of it?

How will my IVA affect the debts and SB clock?

 

4. I have a CCJ,

judgement date Jan 2010,

but can't recall if I've made any payments towards that.

 

 

I read somewhere that CCJs never get statute barred.

I don't even know who obtained it against me tbh.

 

 

How do I go on about the CCJ?

Read somewhere that not paying it will be foolish as it can end in bailiffs knocking on my door.

But then again I don't even know who to pay it to...

they'd have a very hard job in enforcing a CCJ after 6yrs.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
