Morning All , hope someone can advise me as im totally bamboozeld.

I recevied a letter today from 1ST credit who have been assigned by HFC bank to claim a full outstanding balance from me.

How do i find out who are the original creditors?? , i think its was a sainsburys loan that i took out in 2002 that was passed on to HFC bank to chase.

I checked my expeiran credit rating this morning and there was nothing on there from HFC ( or indeed no mention of the couple of creditors( aktiv and connaught) i have agreements with by paying back an agreed monthly plan.)

My score was 994 out of 997 with no ccj's. all green ticks and no negatives going back 6 years. Showing no records before that.

I have mentioned on another thread that i havent paid the sainsbury loan(£9000) since sept 2006, when i went through a divorce and ended up in rehab as i went off the rails.

.I ve been given the advice that this debt is now statute barred. There is no mention of the sainsburys loan on my credit file ( i imagine because i havent paid it for 9 years) and the records only go back 6 years on my expiran file.

the letter this morning has enclosed a standing order, asking for a £10 admin fee, and to set up payment terms.

the thing that worries me is that the balance they are chasing is about a third of the sainsburys loan amount(£3000) . Do you think HFC have written off the debt, And 1st Direct are charging interest on that original amount for the last 3 years since it was statute barred( basically an arbitory figure)??.

Im worried now that if this isnt the sainsbury loan that someone has run up a debt with HFC under my name!, although this would show on my credit file i would imagine.

sorry if this ll sounds like a david lynch film, im just hopless and explaining myself and obviously with fiscal matters.

please advise this poor old sod as my heads in a spin.

many many thanks

there is no link between HFC and sainsburys

so this is a sep debt

I would suspect this was defaulted more than 6yrs ago and has dropped off your cra file.

pers I'd not be responding.

1st credit think they've found a mug

as you've responded to the other one

and are trying to fleece you more

I'd SERIOUSLY consider sending a CCA request to the other DCA's you are blindly? paying?

thanks dx

,sorry mate im not very good with abbreviations on here just yet,

i havent responded to any of the letters from 1st credit re This HFC debt.

I just dont know what it is for .

I just assumed it was this old sainsburys loan .

The other two very small payments i make are standing orders to two DCA'S that i have been paying for 3/4 years .

i assume mate that this hfc debt must be older than 6 years as its not showing on my file .

i wont respond unless they send take me to court with my statute barred letter.

Morning all,

Just another two letters in the post this morning from 1st credit...

The first one entitled... "we accept affordable arrangement offers' Then' inviting' me to contact them and arrange payment terms all friendly and cordial.

The second One Entitled "We are considering taking county court proceedings" saying that IF they issue proceedings they will charge fees etc and attatchment of earnings, bailiffs etc. looks a standard frightner letter to me .

it sounds like a good cop bad cop routine !.:mad2:

if you think wise and in keeping with most advice i'll ask for clarification of the original debt via cca request, if they actually DO issue a court claim .

Once i know what its for, i can send the statue barred Letter to them, as whatever it is its very very old and nothing is on my credit file going back the 6 years.

thanks again to all for any comments and for being there to listen.

  • 5 weeks later...

Morning all, Yourve been very kind helping me with stress in recent months regarding an out of the blue demand from a company Called 1stCREDIT a few months ago , who are demanding full payment of a debt, offering discounts and monthly payment terms etc etc .

I was confused, as ive never heard of 1st credit or had any dealings with them, so i just ignored them, and im now getting weekly letters from them stating that they" are considering taking me to court". Therve been 'considering" for about two months

i didnt know what the debt was for, but i now have more information and i was hoping i could trouble you for further advice.

Just to recap, after a bitter divorce in the early 2000's and a couple of spells in rehab , fiscal matters went off the rails but i have managed to steady the ship in recent years. I had a marbles credit card which i havent used since 2005 which has a balance 0f £3,900. (1st credit have offered me a £1000 discount)

Ive only just found out via a letter from 1st credit ,yesterday, that 1st credit brought the debt from HFC/Marbles in 04/2008.

The thing that confuses me is that i have been paying a company called CONNAUGHT COLLECTIONS £5 per month ( im a house husband)via a connaught all pay card, at post offices, since march 2012 for this debt.

I received a statement from 1st Credit yesterday, which shows a record of my payments for the last 12 months going to them., not Connaught collections.

I notice that both Connaught and first credit are in Reigate, and share the same post code.

If im Paying £5 per month to connaught, as agreed with them back in march 2012, why are 1stt credit sending me letters, introducing themselves to me ,and sending me weekly letters "considering taking me to court" when im already paying this debt to connaught , a fact they(1ST Credit) acknowledge in their statement they have sent to me ??.

Any advice from the wise people of this board would really be appreciated as im getting very stressed out by this :|

just for further info i checked my My exprian report, and it is clean with no defaults or ccj's and a score of 997.

thanks very much, dont know what i would do without this board.

Youch... Youve been paying Connaught? Did the same postcode and location not RING with you that they are ONE AND THE SAME?

If you are paying them then why are they threatening to take you to court?

If this did go to court, as you are making payment to them in one form or another, it would be frowned highly upon to force legal action to get you to pay more.

Have you sent a CCA Request to 1st Credit?

We could do with some help from you.

hello mate, thanks for your reply,

the first half dozen or so letters i got from 1st credit didnt mention connaught or the original debt with marbles/hfc ,so i didnt have a clue what it was about.

I didnt know Connaught and 1st direct were the same people until yesterday, when i got a statement from 1st credit with a list of payments that i had made to Connaught. 1st credit are crediting the payments im making to the account, that they are threating to take me to court over.

I went to find the letter i had received from connaught back in march 2012, they sent me an all pay payment card , and saw that they had the same post code as 1st credit. 1st credit are acknowledging that i am paying the debt in that statement, but i recevied another letter from them this morning 'considering to take me to court' yet again, and offering me a £1200 discount on the £3900 debt.

i dont understand why i have been contacted by 1st credit and threatend with court action over a debt that i am paying at £5 per month using a connaught card that i was sent for this debt.

Perhaps it as an aggressive way of getting me to up the payments to them?. I even got an e mail from them this morning asking me to confirm my name and address, and for my permision for them to contact me by e mail.

I havent sent A CCA REQUEST mate i dont really understand what they are.

opps all the classic signs of being cash cowed.

payment card

massive discount

purposefully obscuring the nature and original of the debt by passing it around.

get that CCa request running

£1PO leave it blank

don't sign anything

might pay you to get an sar running to HFC too

get all the statements

sounds like this is a typical HFC card

prob got PPI and numerous penalty fees.

all can be reclaimed

how did you get spoofed into paying this?

fell for the threat-o-grams?

when did you take it out

tell us a bit more history...

i feel a right mug dx, but as i say i was off the rails big time after thE divorce and rehab spells , and have only recently got myself settled down again in the last couple of years,i just allowed my self to get bullied BY These constant letters so i arranged to pay them all at £5 per month when i got out of rehab to stop the mental stress of the letters.

ive got 4 debts , 2 with AKtiv kapital, one with Lowell and this one with connaught/1st CREDIT, all of which i pay £5 per month each and have done for 3/4 years. I never ever get any contact from aktivkapital or lowell .

Ive just told the mrs of your reply, and i will print off those CCA REQUESTS this week.
