Hi there,

 

I wonder if anyone can help?

 

Quick background- I have recently lost my job, therefore halfing our income into the household :( We do have a family member who has been very generous and offered to pay off some of our debts to help ease the current financial constraints on us and we have begun sending "full and final" offers to our creditors as well as asking for CCA's from the relevant creditors.

 

We have received most details back inc CCA's other than one with Barclaycard. When i initially took out my Barclaycard it was with Egg bank and this changed to Barcalycard later on.... I have been sent back two sets of documents.... one for each company and they are just a copy of the terms and conditions... i have no CCA from either company, no dates or indeed any personal information at all..... i am happy to scan the letter we were sent if that helps at all?

 

Please accept my apologies in advance... i have never used a forum before and have never had to deal with CCA's and the likes before so i have had to hit the ground running. I would like to know if this is indeed a CCA i have been sent despite the lack of a signature or any personal details on the documents. I believe my CC was taken out around 1999 if that makes any difference at all.

Hi,

I don't think I'm alone in suggesting to you that bc 'might' not be able to attain the original terms & conditions from your egg card. I've been waiting nearly 4 years!

Are the t&c for the egg card relevant to 1999? Or just the current ones (possibly t&c for 2011 when bc purchased egg account)?

The experts will be along soon, but I would say 't&cs only' means bc failed cca request and you need to write again requesting copy of cca.

Hi Sumik and welcome to CAG

 

Have you sought advice from National Debtline or similar debt charities. They may be able to help you get creditors to accept reduced monthly payments, and stop adding interest and penalties if those are still being added.

 

Have you filled in a Budget Planner to show creditors what you can afford to repay with the reduced income.

 

Regarding Egg/BC, you can either :-

 

1. Offer to pay an amount based on your Budget Planner and disposable income available pro-rata to all creditors.

 

2. Refuse to pay them until you get employment again, or they provide you with a credit agreement signed by you.

Thanks for the help guys and thank you for moving the thread to the relevant part of the forum :)

 

We were originally paying our debt with Payplan but the disposable income to pay has disappeared with the loss of my job :( I am in the unfortunate position of losing my job in a small town at the same time as two other major employers have gone bust meaning a glut of unemployed factory workers in one area so getting a new job is proving difficult. We will manage to pay our day to day bills and mortgage etc but have one chance to pay off what we can with the money we are being gifted so trying to do it as best we can.

 

I am in the process of filling out the budget details for two creditors that we have offered full and final offers to....... that wont be to hard as what we have coming in pretty much matches what is going out with no wriggle room for debt payments!..... We have been paying over £600 a month towards all this for the last few years and have reduced our debt from over £35K to just under £9k now and hoping we can clear almost all of it asap.

 

The T&C's are not dated (that i can see) so not sure if they are 2009 or 2011 but there is def no signed documents or copies that i have signed at all....... so the next logical step is to write and say we wont offer any payment till we get a copy of the CCA is that correct?... again i am sorry if i am getting this wrong we are learning A LOT in a very small timescale lol...

DO NOT offer a F&F until you have found out if the debt is enforceable.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Thanks for all the help guys........ i sent a request for the CCA and this was what i received from them so do i need to send it again?... Otherwise can anyone link me to what kind of letter i need to send now if its not enforcable?... sorry again if i am missing something obvious.

Hi Sumik,

 

No need to send a 2nd CCA request.

 

In the Debt Collection section of The Library (see the 2 bars across the top of this page), you'll find letters to send to BC offering to make £1 Token Payments; or pro-rata payments.
