    • Hello to all and i apologies if I am breaching any forum rules, any help or advice is greatly received. I traded in my car almost a year ago and purchased a second hand kia optima 2013 with around 75000 on the clock, and 127 a month in HP payments. After 5 and a half months of normal use the engine seized, the reverse camera and sensors no longer worked and the passenger seat belt alarm continuously sounds at various times when no one is seated in it. I had also needed to renew pads and a brake calliper almost 4 months after purchase. I had not raised concerns to the brake components as they would be considered wear and tear.   Being in the industry I dropped the oil and found it to be extremely thick and probably not circulating to the top of the engine, i.e. the oil had not been renewed in a very long time (there is no oil light on the dash or any indication of fault or maintenance due) I retained the oil filter, and opened a resolver case, with tall the faults listed. Upon contacting the dealer and informing him of what happened he indicated he wanted no responsibility towards rectifying the problem as close brothers were technically the owner. I approached close brothers (18th February)who started the ball rolling and approached dealer again who formally by letter refused liability. Close brothers sent  an engineer to inspect my listed problems, which was all visual as the vehicle will not move and after three weeks the report was with my case handler at close brothers. I requested this report twice but have not seen it. Close brothers informed me that the report was inconclusive and they would need to move to a more through inspection. At this stage the pandemic hit, at no point did I stop work and had to continue on charity and the diminished public transport to commute to work (140 miles a week) as no courtesy car or rental was provided.  I maintained contact with close brothers throughout the lockdown, and was given the same update, they were waiting for the engineering firm to do an assessment but they were only doing key workers. Despite me telling them I was a key worker nothing was done until the easing of the lockdown. I was informed that ACE vehicle inspection would contact me to collect the  oil filter.  This happened on the 18th of June and I phoned each week to chase. I was informed on the 30th that the report was showing as on the portal and my case handler (simon) would look at it and call me back. I received no call and called on the 1st with the same responses. Today (2nd July) I got Simon who tells me that the report is showing on the portal but when he went to open it, it was not there and he would chase the engineering firm and get back to me in a couple of hours.   I believe I am being taken for a mug now and am unsure weather I should escalate my revolver case to the regulator or any other advice, I'm therefore at this forums mercy any advice will be greatly received.

    • Hi Everyone DCBL have sent me a Notice of Debt Recovery, saying I must respond within 14 days of the date of the letter. The letter has taken 7 days to arrive, so was either back dated or sent via Dubai. Any thoughts?

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

unheard of debt - motor mile finance

I have received an email from a company called Motormile Finance, they say thank you for payments on my account and they wish to work with me on a manageable repayment plan.

 

I do not know of any debt with this organization.

 

I did , two years ago, have a lot of problem with debt - I was unemployed for a while and experienced quite extreme depressions, I got into a mess and made some bad choices. I did have two payday loans which I stopped making payments on - I had repaid the original amount but not all the interest. One was lending stream and one was my jar. I intend to contact them when I am able to get some sort of repayment organised.

 

What should I do about the email from Motormile? I have definitely never made any payments to this company and the email gives no details of any debt (amounts, or dates or anything) it just gives a reference number which I do not recognice, and my name.

It will be a pdl debt

 

Just remember

They are a debt buyer

So are not baillifs

And have no such legal powers

 

To put it bluntly...Willy waving to fleece money out of you

Yes it will be a pay day loan they have taken over. The reference to payments will be what you previously paid to the PDL company.

 

DO NOT contact them. You should have been sent a letter from the PDL company or Motormile giving you formal notice as to what debt had been transfered to Motormile.

 

Wait for them to send you a letter through the post with more information. You certainly don't respond to an email.

 

Is your current address showing on your credit reference record ? If you have moved, you should always make sure your Bank and other companies you have financial arrangements with, know your new address. This is to make sure thet cannot get sneaky CCJ's using an old address.

thank you... so should I approach the two payday companies and try to sort out the debts I have direct with them? if they let me off some interest I can probably repay them in full in a lump sum... would they let me negotiate to get them wiped off my file?

I am still at the same address, for a few more weeks. I am not aware of receiving any letter from the company or previous PDloaners, but I may have and thrown it away in fear when I was at my lowest :/ I did that with a few things trying to hide from them :(

paying the debt off to anyone will not remove any bad markers nor 'wipe the debt off' your file.

 

 

sadly if you have a default, its there for 6yrs paid or not.

 

 

name the companies please.

He did name them.

 

Lending Stream and MyJAR - I suspect this might be LS as MyJAR have their own DCA company.

i've checked Noddle, nothing on there relating to motormile. i contacted lending stream direct to ask for details of alleged debt & default, as they are thebonly ones listed there.

 

who are MyJar's DCA's?

okay my latest noddle file I received today has two similar entries , one from lending stream & one from motormile. well they have the same start dates in 2013, both say default (no date for that on the motirmile one tho) and differing amounts. what should i do? no reply yet from lending stream

but I would like to get the debt settled .. don't know how to go about this now, who to contact? The original loan was only for £200 and two get two defaults listed (that I am not even aware of getting) feels a bit harsh

 

Is there a standard letter I can use?

Paying wont do anything to remove it. ALl that will happen is you just gave a DCA money for no reason.


Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Motormouth have been plaguing me since 2012 by email threatening to hang draw and quarter if i did not pay up

 

Not once did i respond

 

Shame the accounts are statute barred, and anyway, removed from my credit files

 

Where motormouth is concerned, ignore them

so I have had a look in detail at the two entries on my credit file, from Learning Stream and from Motormile.

They both have the same start due but different account numbers, default dates and amounts owed etc. Is there a standard letter I can send them to clarify what is owed etc? I was also under the impression that only one default be issued for a debt?

There's no requirement to issue a dn to default you.

 

Really? how can I be issued a default notice twice for the same original account, on two different dates, and not be informed??

The Motormouth default might be for a different payday loan

 

Start dates mean nothing with motormouth

 

They had a default for me dated 2012 when the account was from 2007

 

It was also a payday loan and they had it down as a student loan

 

You are correct only one default date, but as i have said, Motormouth are a law unto themselves with data accuracy. They tend to default when the get the accounts, not from when the original creditor defaulted.

A default notice under section 87(1) CCA 1974 is issued if they wish to terminate the account unless the breach is rectified within 14 days

why not send a CCA request for each one.

 

 

if you think they are the same loan
