I have received a 'fine' from excel parking.

 

This is the final reminder,

 

I ignored the first one as i paid for the parking on the day.

 

I know the pay and display was paid as i had a right old moan

 

when i discovered the parking next door was cheaper!

 

Any advice on what to do now?

Yes. Give us a bit more information to work with please...

 

Windscreen ticket? Or ANPR? Date of parking event and subsequent letters, what was the car park for, one supermarket, shop or other?

What is the reason given for issuing the ticket?

 

Post up the NTK if possible. ( redacted of personal information ).

Can you tell us where on their paperwork or signs they have used the word fine please?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi sorry for late reply in this instance.

 

The ticket is a PCN which arrived in the post on the 15 th of June alleging I had breached the car park terms and conditions

on the privately operated car park at snow hill in Wolverhampton.

 

I had parked and displayed a valid ticket on the 3rd June, for 1 hour.

 

I went to pay in a cheque at my bank and returned promptly before the hour was up due to my husband having a hospital appointment that same morning.

 

The pay and display required me to submit my reg before a ticket was issued.

 

I did complain to my husband that the car park next door only charged 60p for the hour

and should the need arise i would se that one next time, was bit miffed I had paid double !

 

I have now received a final reminder for £100 on the 23rd July. Sorry if I confused this as a fine but am old school lol

 

I have searched for the stub from my ticket but to no avail, car is cleaned regularly for teaching purposes

Do you teach people to clean cars.... ?

 

I suspect you imputed an incorrect digit into the machine which would then show up as your car not being paid for

 

But as you can't find the ticket then there must be a very similar car reg in the system from exactly the same time....

If you know the reg of the other car and you "control" it then despite making an error you have paid the prescribed fee and no loss suffered by the parking co. You are officially too late to appeal but do so anyway so a paper trail is created. They can then either accept your appeal and follow procedures or tell you that you are too late and then fall foul of any judge they hope to impress by wasting their time because they havent allowed an opportunity to appeal.

I stuffed Excel twice.

 

 

The first was a POPLA win as excel did not give a GPEOL, and even invented more costs.

 

 

POPLA didn't believe them and so ruled in my favour.

 

 

I then stuffed them around a year later(July this year),

 

 

stating in my letter,"Your losses are not a GPEOL".

 

 

I then finished with

"We've been down this road before haven't we?"

 

 

,and quoted my POPLA win from the previous year.

 

 

They replied back saying the PCN was cancelled with immediate effect.

Morning, Quick update, I did reply to defend the PCN and have received a reply.

 

I states that the car park is an ANPR managed car park which works in conjunction with the pay and display machine in situ.

 

They have to noted the comments I made regarding the P & D having been obtained and after re-checking their data, have located a ticket which could match the vehicle. However, they advised a failure to purchase a valid ticket as the reg was wrong. half for my old vehicle and half for the present one.

 

As a goodwill gesture they are willing to revoke the PCN to a cancellation fee of £10 provided I pay it by 2nd September 2015. Should this not be acceptable or i don't pay by this date they reserve the right to persue the full cost of the PCN . They hope that the goodwill gesture enables a satisfactory resolution to be reached

If you wish to pursue this matter or then refuse to pay the large discount and try for a POPLA appeal, people make errors all the time you just happen to be one, that does not relate to a £10 fee does it? They have 35 days in which to refuse your appeal. Ask for the POPLA number if you wish to continue with the appeals process.

No, dont pay it as they have the correct data to show that you didnt cause them a loss. Their demand that you pay this £10 is probably covered by the 2012 Fraud Act so keep the letter just in case they want to spoil a DJ's lunch somewhere..

 

Had no intention of parting with my cash to them, will donate it to cag for the help received here, thankyou again :)

Please be advised that we have been instructed to pursue this parking charge notice by our Client, Excel Parking Services Ltd. We have not been informed that this notice has been cancelled and therefore the balance of £150.00 remains payable.

 

 

Without payment, the account will be left to progress accordingly.
