    • Thanks for posting the CPR contents. i do wish you hadn't blanked out the dates and times since at times they can be relevant . Can you please repost including times and dates. They say that they sent a copy of  the original  PCN that they sent to the Hirer  along with your hire agreement documents. Did you receive them and if so can you please upload the original PCN without erasing dates and times. If they did include  all the paperwork they said, then that PCN is pretty near compliant except for their error with the discount time. In the Act it isn't actually specified but to offer a discount for 14 days from the OFFENCE is a joke. the offence occurred probably a couple of months prior to you receiving your Notice to Hirer.  Also the words in parentheses n the Act have been missed off. Section 14 [5][c] (c)warn the hirer that if, after the period of 21 days beginning with the day after that on which the notice to hirer is given, the amount of unpaid parking charges referred to in the notice to keeper under paragraph 8(2)(f) or 9(2)(f) (as the case may be) has not been paid in full, the creditor will (if any applicable requirements are met) have the right to recover from the hirer so much of that amount as remains unpaid; Though it states "if any applicable ...." as opposed to "if all applicable......" in Section 8 or 9. Maybe the Site could explain what the difference between the two terms mean if there is a difference. Also on your claim form they keeper referring to you as the driver or the keeper.  You are the Hirer and only the Hirer is responsible for the charge EVEN IF THEY WEREN'T THE DRIVER. So they cannot pursue the driver and nowhere in the Hirer section of the Act is the hirer ever named as the keeper so NPC are pursuing the wrong person.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Installed Win 10 over 8.1 on a laptop.

 

Seemed to install well - but soon got error messages about missing MVSCR100.dll file. Outlook could not send emails - although, strangely it could send test message correctly - but nothing else.

 

Email links would not open in my default FF browser.

In the end, the broken email problem persuaded me to revert to 8.1.

Now everything is working perfectly again.

 

A shame, because it looked very nice and seemed to be quick

You may need to install the 32 bit version Bankfodder - that occurred repeatedly with 64 bit windows 7 and 32 bit apps needing 32 bit runtimes

(I Haven't touched Windows 10 yet and probably won't)

Well I'll wait until Win 10 is more mature and also I'll try it on a spare computer. At the moment I'm away and I'm depending completely on my laptop.

Probably a bit crazy to have tried it anyway before I got back.

lol - partition the lappy HDD if only one drive and dual boot - I do.

 

(to be accurate I multi-boot to separate HDD's in the laptop - which has 3 - it takes 2 and I replaced the DVD with another hdd)

I always set up my installs on memory sticks, although I can drop my bluray back in if needed, but be aware that problems like that Bankfodder is experiencing has happened (and that one specifically) on all 'early release' versions of windows since vista and have often only been resolved by a clean install even when the releases have become 'stable'.

 

I test on my laptop rather than my main machine at home which is a server for a number of things.

 

I always test a clean install of a new OS on a separate partition/drive and migrate apps from my working installation to the new one. Saves the risk of migrating stuff I don't need or want, and usually doesn't end up being any more effort in the longer term - only issue is sometimes drivers which might work if an upgrade is performed, but I'd rather know if there are potential issues early.

You should be getting your copy of Windows 10 from here http://www.microsoft.com/en-us/software-download/windows10

The download tool will automatically set up a usb boot stick, (or dvd), ready for you to upgrade over 8.1

 

Using the above link, you don't have to know the version.

 

You can save it to a stick or a dvd or better still, just click on 'update this computer now' and it will do everything automatically.

 

You can have it wipe everything and just install windows 10 or leave your files and program and install.

 

The best and most sensible way is to let it wipe all and do a nice clean install of just windows and when it is complete, make a recovery USB stick of the OS so should anything go wrong, you can just insert the stick and get back to the original state.

 

Remember it's only free for 12 months, so should anything go wrong after that time, then it's either purchase a copy or reinstall your older OS ie 7 or 8.

Thank you very much. It was exactly the problem and exactly the solution.

 

There are other niggling error messages but as long as the email is working, I can live with it and try to nail the rest one-by-one.

 

I'll post up the other messages later and maybe you or others might come up with a solution.

OK - two more error messages. They seem to be related because they both involve missing MSV??100.dll files

 

One of them relates to ColorUService.exe - missing MSVCP100.dll

 

The second relates to Cs6Servicemanager.exe - missing MSVCR100.dll

 

I don't know what coloruservice is but I'll google it in a minute.

 

CS6 must refer to adobe but as far as I can see, nothing is broken

I didn't. I don't leave photos and things of value on the computer, it's silly, the hard drive can go wrong at any time. I save my precious things to dvd and an external server class hard drive.

 

When I installed Windows 10, I did it as a completely fresh update wiping out everything so I have a computer that is how it would have left the factory. I then made a USB stick with an OS recovery, (all done my Windows 10, no need to know anything), so now should anything go wrong in future, I just recover from the usb stick and am back to square one.

Yes I had to reinstall my Office suite and set up my email again, but that's a small price to pay for a nice fresh and fast computer.

A lot of minor issues with Win10 can be resolved by opening device manager and updating all of the drivers once the install and updates are done. Once you have done all of this then you will need to reinstall some of the patches from your software suppliers or your hardware suppliers.

 

 

Then once you have done all of this go to system then clean up the C: drive to clear up all the nasty left over install, including system restore, the defrag the drive run update once more then once all is sweet as a nut then defrag your registry finally then and only then make your system recovery media for reinstall should you need it. The reason for this method will save you having to re-do all the extra hard-work you have already done...

Is yours a dongle or one of those MIFI devices

 

I have a 3 dongle and works fine, connect using the MIFI device and it keeps dropping to a limited service

 

Seems this is a known problem since windows 8

Well my second attempt at Windows 10 has resulted in huge wifi problems with connections dropping out all over the place. It is almost unusable - so it's back to Windows 8.1 again.

 

Anyone got any suggestions?

With Wi-Fi you will need a good enabled router and have it situated in the right place, this can be done by using a mobile as a guide to the best place to put your router. If you can it may pay your to get hold of a good quality Wi-Fi extender like the WNDA3200 or the Belkin alternative
