      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Wish they would think beyond petty arguments and just try to get along. They don't have to like each other. I make the asteroid comment to make the point that it would take an Earth ending event for some people to put to one side their hatred and to work together for the good of the world.

I'm nothing short of utterly astonished that a deal has been done, even if it does get scuppered, given the forces aligned against it particularly

The oil lobby (Iran has massive stocks of oil it can release to the market as well as capacity - aka price and profits crash for the others)

Iran has as much right to nuclear power as any other country. The Israeli Government are bully's.

 

I hope this agreement will finally bring all sides together to bring peace to the middle east. If Iran can do it, so can Syria etc

 

It isn't that simple, and can't be with the potential for nuclear weapons.

Do we really want a dozen North Korea's?

 

But Iran has shown willing, as has Obama's administration, and an Iran which is invested in the rest of the World rather than isolated from all except rogue states has got to be better for everyone (except the rogue states).

I also think that a powerful state which has some different drivers as part of the world group adds a potentially very good dynamic.

 

The politics are complex beyond belief

Israel, the Saudies, the issue with Iraq when the Yanks leave, let alone the lesser politics of IS and remnants of potential government in the many states of the middle east/north Africa.

 

It could be that Iran extends its influence as the Israelis and Saudis claim, but I can't see that as being worse than the existing situation for the majority of the worlds populace or governments (particular 'interests' could lose out though).

Iran is the main supplier of the worlds terrorist and Isis. Once sanctions are lifted, the main problem country in this world Russia, will flood weapons in so that Iran can supply even more.

 

It's not Israel who are the bullies, it's the country that threatened to 'wipe them off the face of the planet' who are the bullies, and not to be trusted.

Agree. Iran are not supporters of ISIS. I think they are getting help from some in Saudi Arabia and also other countries. Also ISIS raided several Banks and took tens of millions from them. Most of the weapons came from raids on Iraqi and Syrian military bases.

 

As for Israel they went too far the last time in Gaza,when dealing with the tunnels. But cannot be easy living in a region, where they have neighbours who hate them.

Absolutely unclebulgaria - Saudis funding ISIS. Iran has been FIGHTING ISIS

and most of ISIS' significant weapons are US supplied which have 'fallen' into the hands of ISIS from who the yanks gave/sold/horsetraded them to.

Most of the weapons that the Isis jihadists have originally came from libya when all the armouries were looted.

Libya was destabilised by the west because they intended to re-introduce a gold (funded by oil) banking standard to compete with the Wests debt based smoke and mirrors system.

I think that is one of the conspiracy buffs few actual truisms.

 

(and just to show I'm not anti intervention - I believe the assault and complete defeat of Saddam Hussain was not only justified, but absolutely necessary, although I am so very proud of Britain deciding against full blown intervention in Syria)

Why would Israel want to attack Iran? And how would you go about 'wiping a country off the earth"? Oh,hang on...who are those people in mass crowds chanting "death to israel!" as the nuclear deal progressed?

At least as much credibility as I could give to a government that knowingly implements policies which they know WILL throw more children into poverty, and further try to redefine the definitions of child poverty in a puerile attempt to mask the figures showing what a horrendous impact it has had driving more children into poverty..

 

There are horrors in all countries - including our own.

I think ours is worse. Our children have no choices, and have done nothing wrong. and we are in a far better position to do something different.
