morning all im just sorting out my statement request letters for the named bank

im am going to claim back my charges on my cc account however im in a dmp with the cccs and im not sure wjo i chase we pay virgin monthly so is it them we chase if so does anyone have the correct address's needed im not sure of the best place to send

MBNA Act as a credit card facility supplier to a great many well-known branded firms. Knowing Virgin, I think it unlikley it is they who are providing the facility, it would have been MNBA woo paid Virgin a fee to use their name and branding - so, as MBNA is the provider of credit, it will be they who you must sue - but your T&C for the card will confirm this.

morning everyone ive just checked through last months statements, and low and behold my cheque payment to MBNA for statements has been cashed adn they havent sent me my statements???????

they did send me a letter a week ago saying they are looking into my complaint, but i havent complained yet lol only requested my statements lol

has anyone else had any problems getting their statements im assuming (HOPING) they will arrive this week...............................

Yea, I got the same standard response... still waiting for my SAR to come from them!

 

Don't think there's much you can do until the 40 day deadline has passed.

 

be mindful that (from what I've read on here) keeping to the deadlines set out by the guys that know (bankfodder, dave, etc..) is the best way to go. that way if your claim does go to court, the judge cansee you've given MBNA more than enough time to sort out your claim out of court.

got my first serious reply from mbna today.

 

Returned my cheque, said they didn't treat it as a serious SAR, but if I want one (like, YEA! - THAT'S WHAT I ASKED FOR!), then send a cheque and id (LIKE I DID!)...

 

They also gave a goodwill payment of £940 (which is less than half of what they've charged me in six years!)

Hi i have just recieved my statements and an offer for £140, so far i toted up in charges alone not any % charges and thats £450, they have slamed on excessive % in some cases £84.00 and called it credit insurance fees????? but this is something that they have started since summer 05 has anyone else got similar on theirs and can i claim these back?

Not really sure what these insurance charges are, will have a look at my statements when I get home to see if I have anything similar.

Hi

 

You can claim for charges plus intrest on those charges plus contractual rate of interest at the higer rate of your card(Phone to find out).

 

Credit insurance as far i am aware is a untried area but i could be wrong.

You should be aware that when MBNA write back to you they are effectively rejecting your SAR.

 

What this means is that they send you the data they want to in a timeframe of their choosing.

 

The impact of this is tow fold, first of all you don't get all the information to which you are entitled and this may mask the fact that you have charges going back more than six years.

 

Secondly this means that unless you repudiate their rejection and insist on the schedule you cannot complain effectively to the ICO or a court AT ALL irrespective of how long you have waited.

 

If you get one of these letters you need to write back insisting on the timetable you have available to you assuming of course you send the SAR and payment.

 

Oh and the other bit of the story is that MBNA sweeten you up and rely on your ignorance by sending a token payment.

 

The claimant thinks that they're not so bad and so doesnt insist on what they're entitled to.
