My mother has today received a letter from these chasing council tax from 2004 which we don't believe is right.

 

 

It states demand notice and has no deadline,

it also doesn't state the period it is for and unless you make full payment it refers you to the local council to make payment arrangements.

 

 

We believe it was all paid whilst there and the council have made no contact with her regarding this money.

 

 

Is it genuine or phishing and what should be her next action?

However, are you saying that the council (LA) have made no contact with your mother since 2004?

 

If so then this is statute barred and she owes nothing.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Are you sure this is for Council Tax and not a Benefit overpayment (Housing or Council Tax)? Not the usual thing to see a debt collector for unpaid Council Tax.

definitely council tax and not had any contact from council

 

 

it may be 2003

 

 

we moved out and it was in joint tenancy with myself but I haven't received anything and I'm fully responsible for council tax at current house with same council

so they have had plenty of opportunity to contact.

 

 

She isn't aware of a liability order and I would say as the amount is just over £500 then it is mostly fees,

 

 

but she believes as we moved out in March then it was all paid up but we don't have the proof!

 

 

Just wondering whether to ignore as it says an enforcement officer may be sent

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Think I'd be contacting the Council first to see what it is all about.

 

Certainly sounds like someones got their wires crossed, and my money is on them at their end!

If it is for Council Tax then ask the Council to provide proof of when the Liability Order was obtained. It is very unusual that this type of debt is given to Debt Collectors - which as far as I can tell this lot are. If it is & they have not obtained a Liability Order within the requisite time then I'd be tempted to tell them to do one.

Bare in mind though that if there's no liability order already granted then the council have 6 years from the date the amount become due to apply for one - the amount becomes due only when the demand notice is issued for the amount, this may be a date later than the period the charge is for if a demand notice was issued retrospectively for some reason (usually where a council did not receive information until a later date).

they pull these stunts in many Scottish cities

Glasgow etc etc.

 

 

ignore the nno powers DCA

and complain if the council add any charges for 'debt collection'

they cannot.

the only fee they can add is the LO fee.
