Hello All,

 

I’ve briefly discussed this in another of my treads, butit was suggested this should be set up as a new tread, so here goes.

 

Whowas original company: Barclaycard

What type of debt: Credit Card

 

Amount: At default £ 5470 Partially settled.

When account was opened: Originally opened July 2006

Which company owns the debt now: Barclays

Is account defaulted: No – shown as AR

 

In mid-late 2010 I got into financial difficulties. I contacted StepChange (then CCCS) who set upa DMP for me.

This was for a total of 22creditors, which included this debt.

 

All other creditors defaulted my accounts (including oneother Barclaycard credit card account under EGG) in Oct or Nov 2010.

However BC didn’t default this account.

 

 

They have marked my credit files as AR or AP.

I have spoken to BC and they called back today to discuss.

 

 

They said it wasn’t defaulted because the DMP was put in place.

Normally, they wouldn’t default an account until 7 payments have been missed they said.

 

 

They have offered to add a default to my credit files dated Nov 2011; this is one year after my DMP was set up.

They say this date is fair, because that’s a year after the DMP was set up and the first anniversary of the plan.

 

My question is, should I agree to this, or am I better to leave the AP markers, with the account now PS with a zero balance?

 

Any advice or guidance would be appreciated.

IMHO NO.

 

the AP markers never disappear , so even if you pay this off [eventually]

they will remain on your CRA file for 6yrs fro that date

and below that

it will have 6yrs of status available to be view. so can kill you for 12yrs

 

though there is no hard and fast guidelines anmore regarding these AP/AR markers

it is worthy to note

that the ICO guidelines for that time

indicated that AP/AR markers should not be used as an alternate to a default.

 

 

I'd say you need this default to be entered around the time of the third missed payment.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I agree with DX, that you should get the default marker shown as early as poss and I think the 3rd missed payment sounds right.

 

Tell BC, in writing (unless you record your phone calls), that you require the DN to be dated no later than November 2010, in line with ALL your other creditors.

 

Tell them if they fail to comply, you will lodge a formal complaint with the ICO.
