Received CCA from Barclays, however it is very different to others I received from the same bank.

 

 

This Loan dates back to 1999, I have already successfully claimed PPI on this.

 

 

Is this agreement reconstituted?

There's no personal detail on the agreement.

T&Cs very short.

Do they not have to provide signed agreement as per my request?

 

Big question though, can they enforce this agreement?

 

How should I reply?

 

Appreciate if someone can please help me with the reply.

This was a 5 year loan in 1999. Has it been repaid or is there anything outstanding.

 

If you failed to repay as required, were there penalty charges added and do you have full data for these, ie amounts and dates.

Hi Slick

£5800 still outstanding. Charges and PPI already claimed.. Loan was defaulted in 2002 and have been sending token payment since..

Hi Rayn,

 

As you've maintained token payments, the debt will not be Statute Barred for 6 years. Hence, if you stop payments, collection activity can continue including court action if the bank or subsequent DCA choses. The success of such action should hinge on the bank's ability to produce the original credit agreement.

 

However, it should no longer be showing on your CRA files due to the length of time since you defaulted on the debt.
