I have been struggling the last year to pay my Credit cards.

 

 

I stopped paying them 6 months ago and asked for CCAs,

but now they have been passed on to Debt collectors.

 

I requested a CCA from the original credit card company at the time and they sent this reply and the CCA.

 

How do I know if it is valid?

Its a reconstituted CCA.

 

Can someone give me some advice?

When date did you take the Credit Card out originally?

 

Who are the debt collectors?

 

You said passed onto Debt Collectors so are they collecting on behalf of the Credit Card Companies or have bought the debt outright?

 

Have you also had a check of your credit files?

originally 2002 ish with MDSW and 2004 or 5 for egg-both now barclaycard

I got letters from Westcott and also now 2f.

I have checked my file and been defaulted on my payments.

PLease list for each debt

 

1. Original company

2 Type of debt = credit card

3. When opened?

4. Who OWNS the debt now - EG has the debt been sold to a dca

5. Rough balance

6 - Any PPI/fraud protection policies?

7 - Any over limit, late payment, returned direct debit fees on the account?

 

If the answer to 6 and/or 7 = dont know? then you may want to send a subject access request to the ORIGINAL LENDER which should give you the paperwork you need to check and reclaim with interest if applicable.

 

If the answer to 6 or 7 isd yes and you do not have the statements, then read the paragraph above :)

Also anything taken out pre 2007 will need the original agreement to make anything stick in court.

 

Whilst they have complied with your CCA request by sending you a recon, they haven't confirmed whether they have the original.

 

2F ARE Wetcloths, look at the bottom of their silly begging letter and it should say that they are a 'trading name of Wescot'......if it doesn't then that is cause for a complaint.

 

Also whatever Wetcloths are chasing is still with the original creditor (OC) as Wetcloths no longer buy debts, they simply send begging letters on behalf of the OC.

 

You have nothing to fear here, so don't be intimidated by their carefully worded threat letters.

Hi,

1. original company barclaycard

2. debt- both credit card

3. opened number 1: 1999/2000 and number 2 in 2003/4

4. Westcott on behalf of Barclaycard

5. balance 1=8k, balance 2 3k

6. no ppi

7. there will be charges and late fees for the last 6 months.

 

 

having a small issue with some of the uploads, will keep trying.

I confused myself for a moment then.

 

So where is the agreement then?

All you have there is the T&C's from 2014, the 14/08 to be exact.

 

So they have failed already to send you a copy of the T&C's at the time you took out the agreement.

 

And wetcloths can be ignored entirely.

Did they send you anything else?

hi bazooka boo,

I only received the letter from Barclaycard, plus the T&Cs as above. Now receiving letters and calls from westcot.

i'm not quite sure what to do now?

Ignore wetcloths, when they ring answer, laugh and hang up, repeat the process.

 

Alternatively, you could send them the telephone harassment letter, ensure you keep a diary of events regarding their

criminal offence of harassment, with a view of reporting them for it to your local cop shop, if you still have one!

I wouldn't let it worry you, the fact that they have failed to supply you with the CCA is a good start.

 

You can place a notice of correction against the entry on your file if you wish?

 

And should you wish to obtain credit in the next 6 years, then you can always tell the creditor to do a 'manual intervention'

whereby they physically look at your credit file, instead of the computer doing it's number crunching.

 

Sit on your hands, don't let them know they have failed to comply.
