took out a mortgage with platform in july 2005 to purchase my property.all payments paid to date until oct 14.

 

I was given notice by my employer that due to decline in work i had lost my job.

 

 

Seeked advice from money advice service they told me to apply for a mortgage holiday.

Platform looked at our circumstances decided to allow us to reduce our mortgage by £200 per month for 3 months .we accepted this.

 

Halfway through this 3 month period we began to be bombarded by phone calls messages letters with regard to the arrears on our account.

 

 

we replied to these letters after the 3 month period we contacted them as they had not taken our mortgage for the month.

We attempted to resolve this situation with platform .

 

We sent them an offer of a extra £53 per month to clear the arrears on top of our full monthly mortgage payment.

 

 

they wrote back refusing our offer .

But stated that amount would be added to the monthly payment.

nothing changed letters calls ect arriving

visits to our property at £75 plus vat per visit

.reference to solicitors costs also court costs .

 

Everything they threaten us with involves futher costs and debt.

 

 

I have complained about platforms tatics but found they had acted the right way dismissed our complaint.

 

Never planned to loose my job

it happened regret ever asking for platforms help

 

 

.i have a job with the same co earning around £12k per yr.

 

 

Sorry for the caps but i do feel here im getting treated rather badly by platform.

 

 

can anyone please help me utter desperation

Who did you make your complaint to ?

 

I will alert others on the site team for you.. be a little patient, we are coming up to the weekend and Bank Holiday to boot.. we may be a little thin on the ground.

many thanks indeed

 

 

made a complaint to platform under the complaints procedure but

 

 

they said they was right and kicked it out

 

 

just got the 3rd letter this week from them today arrears of £571.10 stating arrears must be cleared

 

 

if failure to do so we shall pass it onto our solicitors

 

 

we are liable to all of our costs

Did you make your complaint to their Head/Registered office and was it headed FORMAL COMPLAINT ?

 

If so and the response above is from them, you can now take your complaint to the Financial Ombudsman. I would suggest that you do, do this because I am pretty certain that they have not followed guidelines correctly.

 

I have left a message for one of the site team to look in on you, but it might not be until later on..

You might also want to send Platform a Subject Access Request - this is a request for all data that they hold on you in respect of your financial relationship with them.

 

It will cost you £10.00 and they have 40 calendar days in which to comply - I am suspecting that not all of the charges they have applied to your account will be permitted - so once you have that information, you can ask for them to be removed from the account.

 

The daily event/diary logs should show how they have treated your situation and will help with your complaint to the Ombudsman.

many thanks indeed yes it was a formal complaint sent to head office.

 

 

im at work very soon so wont be able to reply until the morning

 

 

I would add we reply to every letter

 

 

we send it recorded delivery

 

 

also date on their letter when replied to.

 

 

i continue to pay £53.00 per month on top of the mortgage to reduce the arrears

 

 

.month to month basis arrears will reduce.

 

 

never thought this co would act like this part of the cooperative group

Sadly this is a story we hear time and time again.

 

If this was a formal complaint to head office, then you need to escalate your complaint to the Ombudsman, IMHO. No worries, just keep an eye on your thread for any replies :)

have they ever actually instigated legal proceeding

as if they haven't

they cannot charge and sols or legal fees

 

as for the others

 

any PENALTY fees for letters/visits/arrears etc etc are ALL unlawful and can be reclaimed.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

no action with regard to repossession has begun yet

 

 

they make references in letters to these costs if handed to solicitors

 

 

this company for some reason do not wish to be helpful towards us

 

 

never had arrears until oct 2014 this totalled £600 that has reduced because we are paying £53 extra on top of our mortgage per month

Hi, £53 per month towards arrears is a more than reasonable sum given the arrears are only £600 and any judge would be perfectly happy with that. I think you should write to them again stating that you believe they are treating you unreasonably and that you are maintaining payments towards the arrears. Would you like me to draft a letter for you ?

 

You should also take your complaint to the Ombudsman, we have a letter for that which we can help you adapt. Do you have a list of all the charges and home visit fees ?
