You want to know what is there – but also very importantly you want to know what is not there. For instance, the email that they said they sent you before responding to the SAR – did you see that? Is there any trace of of the phone call that you made to the woman who didn't know anything about SAR's? On what basis was the £50 sent to you? Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it? Also, I think that we need to start understanding what you have lost here. Have you lost any money – and if so how much? Send the SAR to your bank as advised above

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I'm a little confused about the "disability premium" which I asked the council about. I've seen it mentioned before and they seem to keep fobbing it off.

 

The local Housing Allowance in the area is £450 per month (£103 / week), and they're paying £110 towards my rent. They seem to think that it's worked in with my Housing Benefits, but looking at the breakdown I don't see any mention of it.

 

In the HB breakdown, the worked it out as:

 

£90.08 used as my income (after DLA being disregarded and a bit of my Tax Credits disregarded too).

 

They said in their letter (Entitlements Letter) that, the law says that I need to live on "£165.35" per week and as they word it:

 

Income used in this calculation: 90.08

Less how much the law says you need to live on: £165.35

 

Where exactly do I find the "exact" value out, as they don't seem to be able to point me in the direction to where I can find it. Scouting around on the web, I notice that pretty much most councils have Disability Premium listed on their pages, but not mine...

 

Any idea as to how I should approach this?

Indeed, they're paying £110 / week, but I'm topping up an extra £45 / week out of other incomes (rent works out at 155 a week).

 

What I'm trying to get my head wrapped around is how Disability premium works, if I am actually getting it (or is the LA pulling the wool over my eyes).

I've applies for Discretionary Housing Payments (which are temporary) but they'll get me out of immediate crap.

The LA are paying up to the local housing allowance, they won't pay above that regardless of what disability premiums you qualify for.

I know it's frustrating - in similar circumstances we were paying £200 a month when we lived in private housing. It's very difficult, but good luck with the DHP.

The regular disability premium is paid to anyone on any rate of DLA or PIP or registered blind. The severe disability premium is paid to anyone on the mid or high rate care DLA or enhanced PIP and lives alone (or classed as - some people are ignored) and no-one claims carers allowance for them.

Thats interesting as the LA is only allowing for £31.85 i.e. disability premium (not severe disability premium) as I'm on Middle Rate DLA.

in your original post, you stated how much the law says you need to live on: £165.35

 

the £165.35 (which was the pre April figure) is made up of personal allowance £72.40 plus disability premium £31.85 plus severe disability premium £61.10
