I am getting letters from Lowell about an alleged debt that is now well and truly statue barred - doesn't appear on my records and is well over 6 years old.

 

The Lowell letter states at the bottom

 

"You should be aware that the period for recovering your debt by court action has expired, so we will not be issuing court proceedings to enforce payment. However, your debt still exists and legally we are within our rights to continue to ask you for repayment."

 

I object to them wasting paper on this nonsense, I do not acknowledge any debt and will never pay them a penny.

 

Do I have any legal right to tell them to sod off and make them stop sending me these letters?

 

ps: they are generously offering me a 75% discount on the 'debt'. :biggrin:

If the alleged debt is a consumer credit matter then you can write to them and tell them that the alleged debt is statute barred and call their attention to the above CONC rules.

 

They are then prevented from troubling you any further

Just collect their missives, and use them in the bottom of your bird cage, or for your hamster, rabbit hutch............the possibilities are endless!

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

You need to send them a Statute Barred letter - link above. It contains reference to the Consumer Source guide that Bankfodder mentions as well.

 

Once they receive your letter advising that the debt is statute barred, they should cease making contact with you. If, after having let them know that it is SB'd and that you will not be making any further payment to the debt, they still pursue you or sell the account on for another DCA to have a stab, you would be able to make a complaint to the Financial Ombudsman.

 

IMHO, I would send the letter above by a tracked mail and keep the receipt - also print off the RM slip when it has been delivered.
