hi,

 

I hope some of you may be able to help me, I have followed this site for a couple of months and finally got the courage to start my claim last month.

I am claiming £2,176.92 in charges (+£613.84 interest to date) I am not claiming for the interest charged on the excess borrowing as i felt this was enough to pay their costs

I sent the data protection letter

and received my statements within a week and they took the whole £10

I calculated the charges over a weekend using the english simple calculation spreadsheet

and then sent the preliminary letter for repayment

i have just received the reply and it has made me a little nervous, i was hoping that some of you may have had the same reply or may be able to offer some moral support to give my the courage to continue

 

here is the reply in full-

Dear Mr X

 

Thank you for your letter of 29 October 2006, received 1 November and I apologise for any dissatisfaction caused by the application of charges to your account.

 

We believe that our charges are fair, reasonable and transparent. We consider that the amounts debited to your account have been applied strictly in accordance with your agreement with us and our published tariff which, we are satisfied, complies with all applicable laws and regulations. We are also committed to ensuring the transparency of the information that we give to our customers about the operation of our products.

 

We have considered the Office of Fair Trading's statement of 5 April 2006 and do not accept its findings in relation to the setting of credit card fees. We are concerned that the Office of Fair Trading has publicly called into question the setting of charges applied to other products, including current accounts.. The Office of Fair Trading has restricted its investigation to credit cards and made no attempt to consult with the RBS Group or the industry in relation to other entirely different products.

 

Consequently, against that background, we must differ with the views you have expressed and will not be refunding any of the charges applied to your bank account.

 

In your letter you have claimed that we have been acting as your fiduciary, yet I am unsure of the basis of your contention. This does not form part of the normal banker/customer relationship.

 

The bank is under no obligation to explain how its charges are calculated and we are not prepared - to enter into any correspondence on this matter. The compilation is a confidential commercial matter.

 

I am disappointed to note that you are contemplating legal action against the bank. Whilst I hope you will feel able to reconsider, should you decide to go ahead, please ensure that any Proceedings are served on our Registered Office address, which appears at the foot of this letter.

 

I suspect that this is unlikely to be the answer you might have hoped to receive but nonetheless thank you for taking the time and trouble to contact us.

Is this the typical scare letter or have i messed up with the initial letters!!??!!:confused:

its got me quite nervous and unsure as to wether to press ahead?

is this now the time to go for the 2nd letter of repayment

or to hit them with the court action?:eek:

I would be very grateful for any input from people who have won or are going through the same experience

Like you, I wouldn't have the nerve to take on NatWest without the friendly support on this site!

 

I've only just sent my Prelim letter (last Thursday) so I haven't received my first 'sod off' letter yet, but reading your post has helped me be prepared for it.

 

Get that 'letter before action' sent off and stick to your guns.

so the 14 days are up.... and no reply!

did I expect anything else;)

I am going to the moneyclaim site in a minute and start my claim:eek:

this is the first time ever I have used the court system so im a little on edge at the moment

thanks for all the support and help these last few weeks, wish me luck!

does anyone have a formula for calculating the daily rate, im filling in my money claim, do i have to calculate the 8% for each charge then add them up to get daily rate or is it 8% on the whole costs regardless of the date they were incurred?

ive just got there AQ and i am wondering if i am going to be the one that ends up in court!!!

whats going to happen in court

have i got everything right!

am i going to lose, its all going thru my head

and how come they can get away with not paying the £100 AQ fee

im worried any advice for me at this stage i check thru all my papers nearly every night now

i guess im just waiting for the date now

I'm in the same position as you are, Joe90! Try not to worry and let things run its course, there's nothing you can do until a date has been set anyway. Reading other threads it seems to be a possibility that Cobbett's pay their AQ fees in bulk - they must get so many :) !!

Firstly, put all this thought of losing out of your head. The banks DO NOT want to divulge their charging regime. Just imagine the landslide it would cause and every NatWest would probably get all of it's branch windows kicked in by other banks ....

 

Just sit tight. If you have not done so already, you will very likely receive their defence along with a request for further information. There are templates in the stickys to deal with this stage.

 

Just DO NOT WORRY. It is a waiting game and you will just have ride out all the crap they throw at you before the cheque arrives.

 

Take a look at some of the other posts to give yourself a little more confidence. Make sure you read the FAQ's and follow the guidence of this site. You will not go wrong!

ive had their defence and they have requested extra infomation but ive had no instruction from the court to send them any, anyway they are the ones or their clients are the ones who have all the info.

i should wait for the court to ask for my pack or should i send it now? from what i gather from the oher posts i wait for the court to ask i think

im still nervous but it is great to have this forum to calm my nerves

Wait for the court to request the further information. Have they issued you with a cpr18 request??

yeah i had a cpr 18 request from cobbetts but i sent the reply letter in

the latest letter ive had is from cobbetts giving me a copy of the AQ they have filled with the court

in it they state that

"case management directions cannot be proposed untill the claiment serves a reply to the request for further infomation which was due on 16th jan 2007. in light of this the defendant may amend its defence or apply to strike out"

 

other than acknowledgements of claim and service ive had no other letters from the court

Then you are doing fine, just sit tight now and wait for further directions from the court. The information Cobbetts have entered in their AQ is pretty standard, you've replied to the cpr18 request with the letter from this site so you're right on course.

I know the waiting seems forever but the end is in site.

how long is the averege wait?, its been 3 weeks since i got their AQ.

hey hey

 

got my hearing date 12th of march

 

but i also got a request for the court to supply further infomation as stated in question 2.1 from cobbetts

 

i have already sent the bank 3 shedules of charges and since cobbetts got involved ive sent them 2, 5 shedules in all have been sent to them!!

 

should i now send them the shedule with the 8% interest as that is the only one i havnt sent them, also should i send the shedule with the original 8% interest or the latest one as its been 2 months since i started the claim the interest will have gone up by £60?

 

also in this letter they returned my letter refering to cobbetts offer as "the judge has asked to take them of the file as they are without prejudice" any one know what this means and wether or not i was wrong to inform the court of the offer?

 

anyone got a little checklist of things i should check and do now as i dont wont to mess it up, ill be checking over my court pack this weekend and adding any new letters and put the latest shedule of charges in but apart from that i cant think of anything else so if anyone has any suggestions please say
