Hi I am new to this forum and would like some help on a Court Claim form that I have received this morning

 

 

Name of the Claimant ? Lowell Portfollio

Date of issue – . 24/04/2015

 

What is the claim for –

 

 

Shop Direct

 

This claim is for 2661.55 the amount due under an agreement between the original creditor

and the defendant to provide finance and/or services and/or goods

This debt was asigned to/purchased by Lowell Portfolio 1 Ltd, on 14/02/2011

and notice served pursuant to the law of property act 1925

Particuals

Re Shop Direct

A/C xxxx

And the claimant claims 2661.55

The Claimant also claims statutory interest pursuant to S.69 of the county act 1984 at a rate of 8% per annum

From the date of assignment of the agreement to date but limited to a maximum of one year

and a maximum of 1000 amounting to 212.94

 

What is the value of the claim? £3059.49

 

Is the claim for a current account (Overdraft) or credit/loan account or mobile phone account? Catalogue Account

 

When did you enter into the original agreement before or after 2007? Unsure

 

Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. No was issued by Lowell

 

Were you aware the account had been assigned – did you receive a Notice of Assignment? No

 

Did you receive a Default Notice from the original creditor? Possibly

 

Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? No

 

Why did you cease payments? Loss of employment

 

What was the date of your last payment? unsure prob abt 4/5 yrs ago

 

Was there a dispute with the original creditor that remains unresolved? No

 

Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt managementicon plan? No

 

I am not sure that I have done this correctly, I am struggling, sorry

Ok so do i now need to

1 CCA request to Lowell Yes

2 CPR31.14 to Bryan Carter Solicitors Yes

3 Go on line to answer to court papers, or do I have to send in the post

Not yet....you have 19 days from the date on the claim (the date being day 1) to acknowledge service and state if you intend to defend.If you are intending to defend then tick defend all....you then have a further 14 days to submit a defence.

Thank you Ford, I will send of both the cca & cpr in the morning, hopefully I will be able to get on the mcol site later as it is having an internal server problem, are there any trick questions on there I made need help with or is it all straighforward, Thank you

when you get on mcol

 

click the box - register as a individual

 

create a user etc etc

 

you'll get a long ref number note it down.

 

when you have that info

 

back to mcol an select login box

then using the registration details you created log-in

 

once in

select AOS acknowledgement of service

 

then using the details required from the claimform

 

select defend all

 

leave juris unticked

 

and simple exit mcol

 

you should get an acknowledgement you have responded to the claimform shortly after.

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

the discrepancy over account numbers could be interesting

 

 

lets see if they even bother to provide the CCA/CPR.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

Just a quick one please, I note on the court claim form the a/c no is ****5527 & on credit file report it is ****41180, does this matter

 

Lowell may have applied their own reference...but this hinges on the claim form account number...and if that is correct disregard the CRA

Yes the number on the court claim form is 5527, are you saying that I dont send the cpr to Bryan Carter

Sorry I misread that, CRA first ive heard of that on this thread? was i meant to do something with a cra, ime getting a little confused (sorry does not take much) I have to cca ready to send to Lowell & cpr to Bryan Carter can you confirm that these can go today

Your " credit file report " is what we refer to as a CRA...yes send your CCA and CPR 31.14 today
