Hi all

 

 

i recently got a ticket for parking at the local shops

 

 

i parked up went to the ticket machine

 

 

returned to my car and had been issed a pnc

 

 

i have appealed the pnc stating the time the ticket was issused was say 18:07:37 my ticket was purchased at 18:09:10

 

i had to walk to the ticket machine and back

it took just 2 mins

surely your allowed a amount of time to get your ticket ?

 

so where do i stand

 

 

is there a set amount of time allocated to get your ticket

 

 

has this happened to any1 else

 

 

and whats my chance of winning the appel

is this def a council car park or is it private?

 

 

does the ticket say PENALTY CHARGE NOTICE

and only those 3 exact words?

Correct!

 

The parking attendant, hiding behind a tree, observed the op entering the car park at 18:04,

look for a space, park, gain change and walk to the machine.

 

At this point he printed the ticket at 18:07, slapped it on the windscreen, took a picture and run away.

 

I see this every day.

 

Be resigned to the fact that us motorists are a cash cow.

Of course you can appeal.

 

 

You obviously had just parked and was purchasing a ticket.

 

 

What do they expect you to do, drive up to the machine, roll the window down, and buy a ticket that way, blocking access for anyone else?

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Whilst the motorist plainly is allowed a reasonable time to obtain a P&D ticket, there is no precise provision as to the maximum time allowed. In obtaining the P&D ticket the motorist must do only that and not engage in any other activity (such as going in search of change etc).

 

What, if any, is the observation period shown on the pcn?

Yes, can try appeal. Re a case re parking on road, it was said that someone is allowed time to go read the sign and back. Same/similar shld apply re a car park? Partic re having to read and then pay.

Can you post up their pcn /code and their notes on it

It didn't take 2 minutes, the PCN was issued 2 minutes AFTER you purchased your ticket not after you parked so unless you parked next to the machine you would have to add on the time it took you to buy the ticket

No, the ticket was purchased AFTER the pcn was issued.

 

Did you park several hundred metres from the ticket machine ?

 

Unless there is timestamped video or other evidence of you actually parking your car at 18:04ish then the following scenario is just as likely:

 

You parked and went shopping without purchasing a ticket. Then on your way back to your vehicle, you spotted the parking attendant issuing a ticket to your vehicle, you then went to a ticket machine and purchased a ticket.

Really? The PCN doesn't have a "from" time and a "to" time? You might have grounds of appeal if that's the case - it would be useful to see a scan of the PCN. Can you post one up (hide the PCN number and registration number)?

OK iv read your comment a number of times and I'm confused.

 

 

Are you saying that if you took 3 minutes to buy a ticket you deserve a fine?

 

 

I've stood behind people parking up and taking 10 minutes to put money in the machine.

Has paying for a ticket now turned into an olympic sport?

 

Even in the CEO started issuing the PCN the second you got out the car which is highly unlikely you are talking about 3 minutes to walk 50m and buy a ticket which is not likely to win at adjudication.

You still cant explain why you purchased a ticket over 2mins AFTER the PCN was issued, when it should have taken less than a minute after you actually parked.

The meter is only 40m from the first parking spot.

Did you go into any of the shops ? Or stop and talk to anyone on the way to the meter ?
