    • Yep, those 'requirements' not met to shareholders satisfaction seem to me to be: 1. Not being allowed to increase customer bills by 40% (of which well over 50% of the new total would NOT be investment) 2. 1 plus regulators not agreeing to letting them do 'things in their own time (ie carry on regardless)
    • As already mentioned freely available "credit scores" are fairly useless. All lenders have their own "credit scoring" system, that for obvious reasons they don't divulge. And they're "scored" differently to the freely available ones. As soon as they could, we've always encouraged our two children to use credit cards responsibly... Pay off in full, etc, to generate good history. It's paid off. At quite young ages, they have both obtained loans for cars, mortgage and their credit card limits are through the roof. Personally, I have shifted debt around a lot on credit cards (even financed a house purchase once at 0% 😉) and I've only ever been refused a credit card once, sorry twice by the same company, over many years. They must have something very different in their lending criteria. You're a tight one, Mr Branson.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Dear All,

I really hope you can help.

 

 

I have read the other posts but they seem to be rorm a while ago and where debts are old.

 

 

I do have debts but I am aware of them and are paying them all back not having missed payments on 1.

 

 

I received a text yesterday and one today from Fredrickson International saying

'This is an important message. Please contact Fredrickson International on 02031478430 quoting ref xxxx or visit us at fredpay.com

 

 

From reading the information I really dont want to call them but i also dont want to log onto their website and provide my details.

 

Any ideas how i can find out the information without providing any of my personal details which is required online.

Agree with dx. NEVER, EVER pay a dca a single penny until you have done your research in depth.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Ford - I just want to know what debt they think I owe but when I look at their web page it means I have to provide all my personal details which I am not willing to do. The background is that I was out of work for 2 years during which built up a debt but have managed it personally and am paying it off. Now am self employed.

Hi

Have you checked your credit file? This can give you clues as to what they may want.

 

I would use Noddle but they don't update it very often. Usually monthly but it is free!

nope. if they've got anything important to say they can write.

you're not paying anything to freds?

whats on yr file, arrangements to pay? keep an eye on those so that they dont prejudice you more than what a default would.

otherwise, as dx mentions, cld consider looking into all the accounts more fully. eg cca valid, missold ppi/packaged account, charges, etc

I have checked every known debt and am paying more than the minimum each month.

All my old addresses are on noodle, I still can not find what they would like to talk to me about.

 

I am not paying Freds anything

- the ones on file are with banks or on credit cards

- no store cards etc

do all valid debts (very careful with tracking things).

 

 

I track them every month and so that is why it is freaking me out...

I even got a message on saturday and I am sure that I will get one today.

 

I am just not sure how to get them off my back?

 

 

do i use an information request order?

 

 

My nervousness around doing that is providing more information to them.

dont worry.

they'll prob send a template letter in the end, if they've got something to say.

imo, dont do a sar ('info request') to them.

is yr correspondence from old addresses forwarded on?

I don't have redirects any more I stop them after I have moved. Only after 3 years though. Do I need to put them back in?

 

I will have to find out about a text blocked. I'm not bad at technology. But have no idea about that. :-)
