Thousands of law-abiding motorists are having their cars towed away and having being charged fines of as much as £800 after unwittingly falling foul of car tax rule changes introduced by the DVLA. Figures obtained by Guardian Money reveal that DVLA clampings have risen dramatically since October, when the agency did away with paper vehicle excise duty discs.

Before the changes DVLA was clamping about 5,000 vehicles a month, but this has surged to more than 8,000 – with motorists horrified to discover their cars being towed away without even a warning letter from the agency. In total, more than 100,000 vehicles are likely to be clamped this year compared with 60,000 the year before.

While most motorists know that tax discs are no longer required, what is catching out many is that vehicle excise duty is automatically cancelled if a car changes ownership – even if there is a valid disc in the window.

Previously, anyone selling a used car could post adverts saying “Taxed and MOTd” until a certain date. But now when a car is sold the tax, even if it has many months to run, automatically expires and the new owner has to tax it again. It is this change that is exposing drivers to clamping by the DVLA and large fines.

Not forgetting that a SORN no longer transfers to the new keeper either.

Mike,

The all thing is a money making scheme. Is there anything the public can do?

I think this was something of concern when we announced the ending of the tax disc in September last year.

What exactly is meant by"with no warning from the agency" I was under the impression that there were statutory warning letters which must be sent before any enforcment.

I've always got reminders from the DVLA. Received one last week after forgetting to tax my car for over two months. No fine, just reminder.

Shame TFL can't be like this for the congestion charge. If you don't pay within 2 days (remembered on the third day), £65 fine... which I also received this week.

Yes i know that the police can and do tow vehicles stopped if the driver is not insured, but I thought that TAX was just a fine, especially if it was an honest mistake.

  • 2 weeks later...

We've just had this : we tried to tax as soon as the reg certificate was sent to DVLA : it didn't work ( " the vehicle is already taxed " ) then a week later it said in red letters NOT TAXED, but we didn't have new document yet, so tried the reference number in the old document ( V5C/2 ) but it didn't work, presumably because DVLA had by then issued the new document but that didn't arrive till 10 days later !

In Dec I bought a car in a barn. It was off the road and needed work doing to it.... It has never left the barn as welding still needs doing.

3 weeks ago I received a letter asking for tax of £75. I wrote explaining that I was unaware the sorn wouldn't carry over, that I purchased the vehicle late Dec and it has not been off the farm where I purchased it, I sorned as soon as I was notified, yet today received a standardised letter demanding the £75. MONEY MAKING SCHEME. STEALTH TAX
