Yes we have Andy but I'm just being sure I am doing the correct thing - therefore should I get in touch with hoists solicitor direct and negotiate ☺️

You are doing the correct thing the only option you have left...you defended the claim on a statute barred basis...the claim is not statute barred...you have no defence......

I would be contacting the solicitor and proposing settlement by way of a Tomlin Order...dont offer to withdraw the defence...its not required if you can settle by Tomlin.
