Hi Bapsp2000,

 

It's Steve, umm, just a quickie - whats all this about sending a 'copy' of the schedule of charges to the bank and to the court ???

I sent one with my prelim and LBA to the bank, but couldn;t send one to the court cos the MCOL system wouldn't allow it !!

So do I now need to urgently send one direct to the court (Northampton same as your guys) and I asume quoting my case number, or do I wait for the bank to acknowledge and hopefully contact from D&G ????

 

Arrghhh - HELP !!!! ( I just know it will be ME that ends up at the 'Old Bailey' and on the Trevor McDonald show . . . (Richard & Judy are fully booked now LOL )

Ok, thanks, will do that now, take it no need for a letter, just a one liner staing claim ref and saying 'please find attached schedule of charges as unable to submit within the online system' of someting similar ??

Send 2 copies of your schedule of charges, clearly marked with your claim no. + a brief covering letter asking for them to be filed with your claim to:

 

The Court Manager,

Money Claim Online

Northampton County Court

21-27 St. Katharine's Street

Northampton

NN1 2LH

 

Dear Sir/Madam

 

(Your Name) –v- (Bank)

Claim No: ********

Date Issued: xx/xx/xx

 

Please find enclosed a schedule of penalty charges taken from me by the defendant, along with interest claimed at the annual rate of 8% pursuant to section 69 of the County Court Act. The interest in addition to the amount in charges equates to the total amount of my claim, namely £(AMOUNT).

 

I respectfully request that the enclosed schedule should be attached to the particulars of my claim.

Yours Faithfully

 

When you receive the Notice of Acknowledgement send a copy to the bank’s solicitors.

I'm supposed to have sent them off myself but haven't yet. Can't remember where I read it but I think it must be right...as you can see, several people agree!

Sorry for not getting back to you Babs - had one hell of an irong pile! Glad you received help though & very thorough it was too.

 

Halifax acknowledged my claim on 16/11/09 & received the notice from court telling me they intend to defend in full & have until 12/12/06 (28 days from date of service.) Looks like they had a run on the post - wonder if any of us will receive offers from solicitors now or if they really will try to defend claims.

 

I wish I'd done this sooner - the banks are probably getting seriously hacked off with all of this - it'll only be a case of time before they probably do try to defend. I know it's not in their interest to do that, but, can't help feeling very small at the moment!

Hi Zsazsa,

I DOUBT very much they will 'really' defend, it's a 'scare' tactic, they are 'hoping' you will panic and back down, remember they have big law firms and highly paid solicitors at their beck and call - and all it would do is lead to extra costs, loads of publicity and a risk that they may seriously loose and cause a change in the banking codes of conduct and laws - they make approx £3 BILLION a year in the UK alone, why ON EARTH would they risk jeapodising THAT ?????

Stick with it- they WILL pull out, possibly right at the very LAST minute, but there are 100's of blogs in here that say eaxactly that.

 

Anyway, good LUCK (we're ALL in it together)

Hi both,

yes I know its a waiting game and so far 100% win win situation for customers but I know exactly what you mean zsazsa....I feel like a little teeny weeny fish in a biiiiiiig pond at the mo. They've acknowledged me so thats 28 days from the 18th which is..16th dec....awful close to xmas!

Lets hope its sortedmore quickly than that. You and I are about the same Steve aren't we?

I issued and served mine on 8th November 2006. Havent had acknowledgment yet. Im getting twitchy. Wanted mine back for Xmas! Diaried for the 8th to enter Judgment

I know what you mean, my OH is convinced I'm spending hours chatting up girls in here . .ha, if only she new . . most of my 'win' will probably get spent on decorating, a weekend away, shopping trips etc etc . . . (which Mrs steve_n is already planning !! :(

Once more.

 

It is NOT 14 days + 28 Days.

 

It's 14 days to acknowledge PLUS 14 days to submit a defence.

 

Total = 28 Days.

 

So in the example above a defence would have to be submitted by 19/12/06.

Yes, sorry :oops: 14 days plus 14 = 28 in total from served date ! all calendar NOT working (as a lot seem to think)
