I recently parked on a piece of land for the purpose of visiting the local newspaper for a meeting with the Advertising manager

, only a quick visit as he was off sick.

 

Parked in the customer section

after 7 mins returned to my vehicle, disabled badge showing also,

sign clearly stars for customers only,

 

 

to be blocked in by an abusive white van man who started shouting at for illegal parking

and under the wiper blade was a hand written note telling me I have been issued with a ticket ??

No ticket?

 

 

Now they have taken me to court ??

Is this legal ?

 

Do they have to produce photographic evidence or is a scribbled note from a pad sufficient?

 

 

I have a copy of the said ticket but their solicitors are not interested...

Help please , anyone ?

Have you actually been issued a summons?

 

Can you scan & post up this ticket?

 

There is a set procedure before they can issue a summons, and from what you say, they have failed to follow it.

Have you received a notice to keeper, or just got this so called ticket?

Sorry for the delay in replying,

had letters from Gladstone solicitors,

rang them on numerous occasions, brick wall,

 

 

it was sent to court,

I responded,

court replied no further action unless DE LTD want to proceeded,

they have and their solicitors say no mediation ?

 

Got to get a response to Northampton by Apri 2 .

There was NO ticket issued at all ? Just a hand written piece of paper stating I have been reported, frantically trying to find it and the details of my visit to the said business ie the local paper, misplaced due to house move, surely the court can contact the paper direct to confirm this ??

Well, their evidence bundle will be a bit thin to say the least but they are playing a numbers game,

expecting you to pay up rather then defend.

 

The courts wont contact anyone,

you have to do all of the work otherwise you will lose and this is what they are hoping for.

 

Get down to the car park and photograph the signs and also get into the building

and find out who you spoke to on your original visit.

 

 

If there are no signs make sure that you photograph the entrance to the land

and the parking bay as a nice panoramic view.

 

What paperwork have you received in the post since the day in question?

What dates did your receive it?

Did you respond to anything in writing?

 

 

All these are critical as the hand written note should contain certain information

that is needed to be compliant with the law you must find it.

 

In the meanwhile,

demand a copy of the original "ticket" from the parking co as a CPR 31.15

along with a copy of their contract with the landlord

that allows them to make claims and take legal action in their own name.

 

Find out who owns the land,

probably not the company you visited so that will show if they fail on that point.

 

Your response to Northamton CC is you are defending in full on the grounds

that co contract was formed to be breached and DEL failed to follow the protocols of the PoFA

(wont automatically beat them on this as they are chasing you as the driver)

and DEL know this so their claim is vexatious.

sorry but a lot of people post asking for help when it is late in the day and then just slink off never to be heard from again because they have either settled and dnot want to say so or the whole matter was dropped and they think that their troubles are now over so there is no need to report back. We like to hear about the outcome, whether good or bad as it allows us to see what the parking co's are thinking and doing, good or bad.

I was getting that impression ericsbrother, but I try to think the best of people in the hope that they might not come into that category, lol.

I've got my own thread but was just wondering how this turned out.
