      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi there

 

I have received a letter today from Lloyds Bank asking my for a repayment plan saying I owe them £1030.24

 

I had an original debt with them in 2003 which was and is being dealt with by Payplan.

 

I have checked on my Payplan account and even though I have been paying them every month for the last 12 years I still owe £174.

 

I am really confused how having paid over £5000 towards a debt of just over £5000 I am now still owing over £1000!!!

 

I understand that they can still put charges on but is it unreasonable to stop paying seeing as I have now cleared the original debt? I feel like I am going to be paying this forever and ever. As soon as I feel like I am nearly at the end of it all I am landed with a request to give them another £1000.

 

Can anyone suggest what my best option is?

Should I request a CCA and see if they can provide it?

Should I write to them and explain that I have paid x amount and that I have cleared the original debt?

 

 

I really don't know what to do and am at the end of my tether :(

Okay well first you need to send to find out whether its enforceable. I would imagine that they should have defaulted this by now.

You could also complain about the card, say you suspect that you are paying way too much etc,

 

Also reclaim any charges, Defaults etc.

HI there

 

OK here is what I advise.

 

1) CCA request to the creditor who is being paid by payplan.

2) Full Subject Access request to both the creditor AND payplan (Time to see where your money went!)

 

Those should give some clues as to whether they have paperwork, if any paperwork is enforceable.

It should also give clues as to if there are Over limit charges or late payment fees that can be reclaimed with compound interest in restitution. You *Might* have some money due to you!

how many other debts have you got in this DMP?

 

have you ever questioned the legality of the debts by sending a CCA request to each company you are paying?

 

sadly, no DMC will ever check the legality of any debt for you

 

they just take what the owners of the debts

be that the original creditor or the debt buyer [a DCA] that you do owe that money

 

and if there is anything to reclaim

like PPI [no there is no time limit] or unlawful PENALTY fees for being late/over limit, phone calls, letters, defaults or rejected transactions

 

can you please list your debts paid through PP and whom the money foes too

 

on this credit card I'd be sending Lloyds an SAR

 

get all the statements

I have 9 including the Lloyds ones.

 

Most are now done through collection agencies like Moorcroft and Paragon.

 

 

I did have a debt with Marks and Spencers but they wrote to me two years ago to say that they were finalising the account and it would be closed.

 

I think I am going to contact them all regarding CCAs

as looking at my Payplan account most of the debts seem to have been passed around to several collection agencies

so I am thinking they may not be able to find the CCAs!

 

I can't remember if I had PPI on all of them

there was definitely on one of the debts but it is so long ago since I defaulted on them

and the repayment agreement was set up through Payplan.

 

 

If they cannot provide the CCA

 

 

how would I go about seeing if I am owed PPI?

oh dear this is beginning to smell like you've been cash cowed on many debts.

 

 

the PPI question can be answered by sending the OC an SAR.

 

 

theres little point in sending a CCA request on debts that are already paid off

 

 

and just remember, the CCa does not apply to bank accounts or mobile debts.

These are the original debt amounts:

 

Barclaycard - £1,894.44

Barclaycard - £1,902.65

Cabot (previously equidebt) £1,311.50 - Abbey National

Cabot account (abbey account) £1,284.98 - Co-operative Bank

Collect direct £440.15 - Ikea

Lloyds £5,144.22

Moorcroft (HBOS) £1,180.76 - Halifax

Moorgate (MBNA) £ 4,102.23 - MBNA

Moorgate (MBNA) £ 2,395.58. - MBNA

 

Interesting to see that the Ikea original debt is £440 but they say I have paid £583 but still owe £463!!!

 

No mobile debts - one loans the rest are credit cards and store cards!

 

So is it worth spending the £10 per SAR and how would I go about reclaiming anything I am owed???

you only need one sar per 'bank/group'

so say with the bc debts, you don't need two.

 

 

pers I'd be slowing down a bit now

Also can you add Year account was opened and also confirm the type of debt eg Credit card/catalog etc.

 

This will help people give advice :)

Hi - thanks for your advice

Sadly I don't know the dates or even years of the accounts being opened as I have no paperwork due to it all being so long ago. The only information I have on any of them is what is on my payplan account!

nope if all you old addresses are showing

 

 

it prob means the debts were defaulted more than 6yrs ago and have been removed.

thus they cant hurt you anymore nor return to file
