Yes that's right. The rejection letter is here. You are accepting it but on the understanding you will continue with your claim for the remainder.

You can start your MCOL 14 days after your LBA was sent.

Help feeling sick that may have ballsed this all up when I sent my LBA I didn't include interest in my claim just gone to go forward with MCOL and read the warning that I should have done this HELP!!!!!!!!!!!!!!!!!! Sob sob sob!

You can include the interest when you submit your court claim. I think a little read of the FAQS and step by step instructions might be in order. :wink:

That's what I thought when I read the FAQ's but then got worried when I went to submit the MCOl, does it show that I'm nervous?! :confused:

 

 

Dont worry as long as you have included the interest at the MCOL stage you are fine. I would again take some time to read some more.

Gulp! Have just completed MCOL and paid £120 in court fees!

Sorry to go on about this interest thing but ticked the box saying I wished to claim 8% interest online, is that it or do I have to send a copy of my schedule of charges including interest to Halifax and inform them I've issued a court claim?:confused:

Send 2 copies of your schedule of charges, clearly marked with your claim no. + a brief covering letter asking for them to be filed with your claim to:

Dear Sir/Madam

 

(Your Name) –v- (Bank)

Claim No: ********

Date Issued: xx/xx/xx

 

Please find enclosed a schedule of penalty charges taken from me by the defendant, along with interest claimed at the annual rate of 8% pursuant to section 69 of the County Court Act. The interest in addition to the amount in charges equates to the total amount of my claim, namely £(AMOUNT).

 

I respectfully request that the enclosed schedule should be attached to the particulars of my claim.

Wait until you receive the Notice of Acknowledgement from the court and then send a copy to the bank’s solicitors, since they are the ones who will now be dealing with your claim

Please find enclosed a copy of my schedule of charges relating to the above claim.
