Hi all, coming home from work today I received this letter:

 

ENFORCEMENT NOTICE

I have called today to execute a liability order issued to us by our client havant borough council.

I am authorised by the court to remove your goods/vehicle to satisfy the outstanding balance of £726.24

If you fail to contact me in 24hrs I will have no alternative but to re-attend your proterty to remove your good for sale.

to avoid further action call me on ****

 

Client debt: £416

Court Fee: £0

Compliance Fee: £75

Enforcement Fee: £235

Total: £726.24

....................................................................

 

I Also live in a flat that you have to gain entry through a communal door, and then my front door.

 

I have rang the number and he told me I need to speak to friends and family,

I can call him back to pay tonight or in the morning because I have got till tomorrow to pay it.

 

Can anyone give me any advice?

 

Can he gain entry by force in anyway or use a locksmith?

has he really been to court for this as there is no court fee?

 

what are my rights?

please help.

You do not have until tomorrow to pay it

The bully boy is relying on fear and intimidation

 

The only goods that could be removed are items outside as there is no right of entry

No locksmith

And you do not have to let him in either

 

What is the story before now have you received any letters what year is this debt for?

Are you working

Ok thankyou,

 

 

I believed council tax benefit paid my council tax as my hours got cut short in September last year and

 

 

I went down to 14hrs P/W and

 

 

I started receiving housing and council tax benefit,

 

 

however I have just been told by the bailiff himself that council tax benefit paid £11. of it for me,

 

 

I never received any letters from the council or anything..

Contact the council, btu be warned. The back offices are outsourced to the company that owns capita, so you need to be strong and put your foot down.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Ok thankyou, i will contact them tomorrow, but theres no way he can gain entry on his own tomorrow while im not here is there? Or am i safter taking my stuff with me? Thankyou

No forced entry

As you know they MAY be about keep your front door locked at all times

Does not matter if he gets through the communial door in to the flats he can not force your front door

No forced entry at all for a council tax debt unless they have previously been allowed peacful entry and performed a levy or whatever theyre calling it now. . Get complaining.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

moved to the bailiff forum.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hide any cars a gopod way away, as has already been stated, they cannot force entry to your front door, even if they get through the communal entrance door. Ifd the EA tells any third party as in neighbours details of the debt, then they are in breach of the Data protection Act. sit tight help is on the way

 

Have you had any other correspondence from the council before the Equita bod showed up?
