      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi there i am new to this and i have searched on the A&L as it is them i am battling. I have sent the first letter to which i had a reply saying that the OFT do not think the bank charges are unfair, it is only credit cards????

To explain the situation- in August i had approx 100 charges for Dd. I asked for an overdraft ext to stop further problems this was refused and i was told to get a loan, this also refused. From August to end of October they have taken 500.00 in charges. Basically making money out of me as they know i was having problems. Anyway what do i need to do now???????

Right, 14 days are up and not a peep from these stupid people. Do they never learn.

 

Had a call from an outside company this week, Global something or other, demanding the £120 i paid the A and L short last month. So i paid them out of my halifax winnings!!! :)

 

Anyway, of on a tangent again.. I really do have the memory of a goldfish!!! as someone else once said!!:)

 

So now its the next letter, off today, and boy am i looking forward to the phone calls these people will make to me next week...all the way from bloody India as well...

Parachute CC now set up..just in case, and its 0% for 12 months!! .. gonna have these people jumping thru hoops before long...

 

No phone calls from our flip flop wearing friends in the Faaaar East, sure they will when the leccy comes back on.. Not sure that their training tells them how to deal with a mad, cat eating, opinionated bank baiter from Beds tho..

Got a reply to my prelim, 23 days after sending it asking for time and they would respond by the 11th Dec!!!! Dream on Mr A+L...

 

Anyway, sent them and LBA on Monday as they hadn't replied by that time. I'm sure they will now call in my CC debt as a retaliatory action, but guess what..... too bloody late!!!!! I have moved it over to Marbles...

 

Far to quick for these dinosaurs, bring it on baby...

Hi Pretzle06.

 

I've recently made a claim against A&L for a refund of bank charges of £1181.24 (not credit card charges), and have this morning received a similar reply to yours, informing me that they consider these charges to be fair and appropriate. Have you started the legal proceedings yet?

 

Has anyone else had a similar reply to me & Pretzle from A&L?

right guys, need some help with this. Got another letter today and it says.

 

' You should be aware that the account number that you have qouted is in fact an MBNA cc and therefore any action that is issued should be directed towards MBNA'

 

So, my question is who gets the next letter , do i have to start again or is it just a fobbing off exercise?? And who do i have the next row with?????

 

My card is an A+L card, i always ring them whenever and all my statements are from them..

 

Answers on a postcard please.

You do need to deal with MBNA for the credit card.

I suspected A&L would try and pull the wool over my eyes in the hope that I give up, but it's worth persuing for the refund, despite the fact they'll close my account. Guess I'll just open another with someone else or even with them again before proceedings commence!
