    • We used to recommend that people accept mediation but our advice is change. The mediation process is unclear. Before you can embark on it you have to agree that you are prepared to enter a compromise – and that means that you agree that you are prepared to give up some of your rights even though you are completely in the right and you are entitled to hundred percent of your money and even though EVRi are simply trying to obstruct you in order to discourage you and also to put others who might want to follow your example off from claiming even though they have a legitimate basis for reimbursement. Mediation is not transparent. In addition to having to sign up that you are prepared to give up some of your rights, you will also have to agree not to reveal any details of the mediation – including the result of the mediation – so that the whole thing is kept secret. This is not open justice. Mediation has nothing to do with justice. The only way of getting justice is to make sure that this matter goes to trial unless EVRi or the other parcel delivery companies put their hands up and accept the responsibility even if they do it is a gesture of goodwill. Going to trial and winning at trial produces a judgement which we can then add to our small collection to assist other people who are in a similar boat. EVRi had been reading you around by the nose since at least January – and probably last year as well – and their whole purpose is simply to drag it out, to place obstacles in your way, to deter other people, and to make you wish that you'd never started the process and that you are prepared to give up your 300 quid. You shouldn't stand for it. You should take control. EVRi would prefer that you went to mediation and if nothing else that is one excellent reason why you should decline mediation and go to court. On mediation form you should sign that you are not prepared to compromise and that you are not prepared to keep the result secret but that you want to share the results with other people in similar circumstances. This means that the mediation won't go ahead. It will take slightly longer and you will have to pay a court fee that you will get that back when you win and you will have much greater satisfaction. Also, once you go the whole process, you will learn even more about bringing a small claim in the County Court so that if this kind of thing happens again you will know what to do and you will go ahead without any hesitation. Finally, if you call EVRi bluff and refuse mediation and go to trial, there is a chance – maybe not a big chance – but there is a chance that they will agree to pay out your claim before trial simply in order to avoid a judgement. Another judgement against them will simply hurt the position even more and they really don't want this. 300 quid plus your costs is peanuts to them. They don't care about it. They will set it off against tax so the taxpayer will make their contribution. It's all about maintaining their business model of not being liable for anything, and limiting or excluding liability contrary to section 57 and section 72 of the consumer rights act.

    • too true HB, but those two I referred for starters - appear to be self admitted - One to excuse other lockdown law breaking, by claiming his estate away from his consistency and London abode was his main home the other if he claims to have 'not told the truth' in his own words via that quote - to have mislead his investors rather than broken lobbying rules   - seem to be slam dunks - pick which was your law breaking - it seems to be both and much more besides in Jenricks case Starmer was director of public prosecutions yet the tories are using seemingly baseless allegations for propaganda and starmer is missing pressing apparent blatant criminality in politics
    • I am sure the resident experts will give you a comprehensive guide to your rights.  The responsibility lies with the retailer. I have dealt with Cotswold before for similar. And found them refreshingly helpful.   Even when I lost the receipt for one item I had bought in Inverness. The manager in Newcastle called the store. Found the transaction and gave me a full refund.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello to everyone,

 

 

I am looking for help regarding a claim I started in January regarding a PPI policy I knew had been missold on a loan taken out in 2002.

 

 

I rang Halifax initially and once past addresses etc were given I was found on the system.

They sent a questionaire and I completed it.

Then about a week ago a Halifax employee called and asked a few questions regarding other loans I had held.

 

In total 7 loans, over an 11 year period from 96 to 2007.

Constantly rolling them on.

The Halifax employee said 4 of the loans had PPI which prompted me to do an information request.

I got back 6 standard letters with individual loan numbers on stating

 

" Subsection 77(3) of the Act provides amongst other things that section 77(1)

does not apply to an agreement under which no sum is, or will or may become, payable by the debtor.

 

 

The above loan was repaid on xx.xx.9x this means no sum is, or may become payable by the debtor

and therefore the bank is under no requirement to provide a copy of the agreement,

any document referred to in it or a statement of account"

 

Two of these had details attached though, showing no PPI taken.

One has details attached showing single premium PPi taken out without my consent.

Three have no information attached at all and the last loan,

the one that prompted the claim is not mentioned at all?

 

My questions are,

do I need to do an SAR for the full details?

 

 

And if/ when they come back to me,

what course of action do you advise?

I havent a clue how to work out what is owed.

 

 

The PPI shown on the agreement from 1997 they did send is @ £1000 plus over £320 in interest.

And the last loan in 2002 is over double that.

The last loan taken out was only available IF I took out the PPI at the time.

 

 

Am I right in thinking that conversations were recorded by 2002?

I said point blank it was not required but was told "no PPI no loan."

 

All the policies were mis sold as I have serious health problems starting well before the loans were taken out.

I have had months off work at a time, plus long stays in hospital throughout my adult life.

I am now registered disabled and the worry of doing the wrong thing is not helping at all.

 

Any help or suggestions welcome,

 

 

I just want recompense for the money I paid out upto 18 years ago.

once you have the info.

 

 

if all of these were in a refinanced 'chain'

and read link 1 below to work out your expected redress.

I have now completed a template SAR leter with all my past addresses and current details plus the loan agreement numbers.

The £10 cheque is enclosed as well, is there anything else before I seal it? Can I also confirm the address to send the request to

I will now complete the Questionaire you sugested and send it to the Halifax as well.

Is it then a case of wait until they get back to me?

Having just done a PPI reclaim for my mother, who had no idea she even had it!, I have to say Halifax

are extremely good at coughing up, (surprisingly) Sent a SAR off in October, then sent off the claim in December, and the cheque arrived last week, a nice four figure sum.

 

Halifax have their own PPI reclaim form to fill in, I'll see if I can find the link, but it's on their website...

SAR Letter now posted to HBOS at Leeds. I will just wait for the information now.

 

I have looked at the spreadsheet and may need a few pointers once I have all the dates etc.

 

 

regarding what to do with loans that are settled with new loans and when they swap from having PPI to not having.

 

 

Would it be ok to contact you again when I have the info?

It was extremely easy and very straightforward, no arguments, no ''We don't agree it was miss sold'' etc, simply, it was a very quick painless, OK here is a figure we are prepared to pay you, I have absolutely NO IDEA why anyone would ever want to throw money away at these fleecing PPI claims companies, there is absolutely no need.

 

Mum was happy, although I did say it realistically might be more, but no, she was very happy and is going to buy

some new furniture for the conservatory!

Hi again,

 

Well today I have received an offer letter from Halifax. just under £3500.

 

Firstly a thank you to CAG for giving me the nerve to make a claim.

 

Secondly there is an issue with the final offer.

They have omitted one loan from the calculation completely, i had 7 loans in total.

They have sent the offer with only 6 listed.

They have also altered the original 4 loans with PPI I was told about to 3.

 

 

The strangest thing is the only details I had and started my claim with is the loan they now say doesnt have PPI,

but when I originally contacted Halifax the lady confirmed it had PPI and started my claim.

 

 

It was 3 weeks later someone called me and said there were 4 loans in total with PPI.

 

I called the unhelpline today and struggled to make the person understand,

they kept saying you have never made a claim on the missing loan but I said I only started a claim on 1 loan,

your colleague has found the others.

 

 

He eventually hung up on me so I called back and started 3 complaints.

 

1. The loan not being included in the calculation

2. The loan I started the claim with not now having PPI when I was told it did have

3. Being hung up on by a call centre person who couldnt understand what I was saying

 

Enough of the rant, my questions.

 

Can I accept this money and carry on claiming when I get my SAR paperwork back?

 

Do the banks not pay any amount over the PPI plus interest in way of apology? ie. An additional amount for inconvenience?

 

Can I claim postage, SAR request £10 etc. back? I know its petty but after today I want my pound of flesh.

 

Did they record conversations in 2002?

 

Most importantly,

I was under the impression that all of a single premium policy would be refunded,

I paid over half the payments before the loan was rolled into a new loan.

They have shown no rebates in their offer.

Hi dx,

 

You are the voice of reason again, I am just so angry today.

 

 

Being talked to like a child when they are the ones talking nonsense is hard to take.

 

I have only just sent the SAR this week so if it takes 40 days their offer wiill automatically have paid out according to their letter.

 

Hence me asking if I can take this money and carry on fighting or do I have to refuse the offer on the grounds of the complaints and awaiting the SAR?

 

I am not a wealthy person and £3500 is a large sum at the moment,

 

 

I dont want to jeopardise anything but the numbers are wrong as even if the missing loan has no PPI

 

it would still affect the calculations in my favour.

I cant see any point in you actively accepting or refusing the offer

 

 

let them choose.

 

 

if/when you get the £3500 it would not jeopardise your future claim.

however specifically accepting it would be a bad move IMHO.

Today's twist.

 

 

The cheque has arrived.

 

 

The day after the offer letter and me complaining the figures are not correct immediately by phone a cheque arrives.

 

 

It is incorrect but should I bank it and wait for the difference once I have the Sar results?

 

 

The final amount will be higher as they have left a loan off their calculations.

IMHO I would not bank it just yet, keep hold of it yes just hold off banking it until you get some answers to your questions,

and the SAR..
