Made a claim for PPI on an old loan form 2001.

 

HSBC have sent a letter saying they paying refund to Metro

 

Can they do this?

 

Anything I can do to get the money paid to me?

Defence entered

£279 refuned £521 outstanding on claim

Hearing 15th Nov 2006

Hearing 18th Jan 2007

Defence Stuck out - £549

March 07 Bailiffs called in to collect

20/4 Cheque for £549 - I WIN

 

Abbey - Setteled in full 9th Nov 2006 £3,300

 

Abbey - Data Protetion Act informtion

ICO complaint logged

 

Abbey - N1 Logged - 12/02/2007 £933

FOS Complaint logged 07/03/2007

£180 refunued -Good will Gesture 01/04/2007

metro are HSBC

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

depends. Did they say metro are acting on behalf of them ( theyre the same company). If so, then why are they paying it to a DCA that really has no legal rights. They should have offset it themselves.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

I realise that metro are part of HSBC.

 

I took a loan out in 2001 for 6k in a HSBC branch PPI was included in the loan ( i didn't know it was)

 

I had an accident at work which made an existing sports injury worse and was unable to work and ended up needing surgery.

 

I went to the same branch I took the loan out to sort out how i was going to manage without an income.

 

I was advised by the branch staff that I couldn't claim on the loan PPI as the injury was pre-existing.

 

I then had to move home as I could not afford where I was staying and also changed banks.

 

(13 years later) when I got a letter from HBBC saying I might have been miss sold PPI and fill in the form.

 

It was sent to an old address and got forwarded to me.

 

 

I filled in the form and got a reply which is a bit odd

 

it just a calculation sheet saying:

 

PPI premium redress xxxx,

plus interest at 8% xxxxx,

less basic rate tax xxxx ,

OFFER xxxx,

less amount paid to metro xxxx

NO REDRESS DUE

 

 

The old loan would be statute barred now anyway.

But can I get the PPI refund paid to me?

Yes. They're pulling a fast one and you may have to go through the fos to get it.

metro are hsbc in house DCA

it cant be sold to them

and even if it were

its still HSBC so they can offset

and even if its SB'd to

 

 

SB in E&W simply means no court can be used.

 

 

however, the 8% SHOULD have gone to YOU directly not used for offsetting.

So i should revived a cheque for the interest of £50?

the rest they keep?

 

Now as i had a valid claim but couldn't claim as pre existing condition should they not consider the claim and pay out?

you should get the 8% back but minus 20% tax.

 

 

not worth the arguing me thinks.

 

 

revisiting if you could have used the PPI is interesting.

 

 

whats the payment schedule 12 months only if you claim

check the agreement T&C's
