I would accept their consent order.....and then issue your own claim...that is properly particularised/quantified and CPR compliant...the above cannot be regarded as a valid part 20 claim.

that was my thinking but if there was an unless order and their claim would be struck out by the court why can't i leave that up to the court. if i agree to the consent order i am in effect agreeing to the counterclaim being dismissed. where would i stand if i then issued a claim afterwards. finally if it against the original creditor or the lowell?

Whether the court strikes it out or both parties agree to the claim being dismissed by Consent...is one and the same in my view.With regards to the counter claim I have already advised on that in post #126...it isn't a valid counter claim.
